I worked for this company for almost 5 years.  Upon our home selling, we decided to move back to TX to assist in the care of my mother.  I filed for unemployment after a few months BC most employers don't want an employee who might need to take off to take a parent to the Dr or assist in other ways.  My unemployment benefits were approved.

The owner filed an appeal and fought my collection of unemployment, as he had with previous females who left or was fired.  However, the men were allowed to claim their unemployment and he would pay them under the table, so they would not lose their unemloyment benefits, to assist with services.  Basically, since I did not discuss my personal life with my employer, ask for an extended amount of time off, or provide a Dr statement, which I did not know I needed to, I was denied further benefits, because of his appeal.

Mr. Ninde's concern, supposedly, that his unemployment cost would go up.  However, he did not worry about that with the men.  As far as an extended amount of leave, this was not feasible because he required me to be present in his absence, which was a minimal of two(2) times a week, more during nice weather so he could play golf.

I was the only employee for the accounting dept, so there was not anyone to cover my position and enable me to take months off at a time.  Not to mention the health issues with my mother are not going to go away, they will continue to get worse until she dies.

This lack of income, even though it was minimal, has caused us to lose a vehicle, and make it a hardship financially.  I am still unable to find a job and be available for parental concerns.  Evidently, OESC, does not feel a need to punish him for discrimination or unlawful payments to males who were receiving unemployment benefits from Ninde Funeral Directors.

i also live in tulsa and understand how difficult it can be in our good ole boy system. i am a male and left a job in t-town and was approved benefits until the employer WESTLAKE ACE HARDWARE objected and the checks stopped. i was told since i left on my own that westlake wasn't responsible(this came from there lawyer, not the court) i didn't think it would be profitable for me to retain a attorney and fight it. You seem to have a much better case than i did and if i were you i would fight it...BTW the local news stations love news like this and i would call channel 6, 8, 2,  and especially fox23, they would love this story.

Talk about missing the point.

I believe that the consensus here ( and that of the Unemployment office) is that you are not eligible to collect unemployment benefits for voluntarily leaving your job.

   You claim not to feel entitled, but in fact you're complaining about not receiving public benefits that are not supposed to go to people who voluntarily leave employment (except under very narrow exceptions).

    Are you saying that the employer should have let you slide and allowed you to collect benefits for which you were not entitled?   Sure sounds like that's what you're suggesting.  

   Pardon me if I don't completely swallow your dubious anti-female conspiracy.   You've demonstrated little knowledge about how and why unemployment benefits are disbursed.  I don't think you know enough to judge whether others are receiving benefits correctly or not.

So y'all agree he is right in the fact that he only appeals a female request for unemployment while paying the ales under the table while collecting unemployment from his business? Think y'all are missing the point here....

You post on a public forum and don't want to be judged?  How does that work?  It appears that you did not wish to communicate with your boss.  You said you would not talk about your personal life yet you post it here.  You did not request permission for extended absence nor provide a doctor's note because you did not know you needed one.  This is where communication comes to play.  This is not Ninde's fault.

You should read up on legal reasons to leave employment, in Oklahoma. One of them is family medical and I hope you never have the ability to judge others for leaving employment. I am nt one of those dead beats who live off the government. I have worked over 35 yrs and never filed for unemployment benefits, so until you have walked in my shoes don't be so quick to judge.

I can confirm what Dave said, at least in the state of Oklahoma. In fact, I'll go a little farther and say that those who are terminated for cause (fired) will generally not be eligible for unemployment benefits. Oklahoma will generally pay unemployment only in the case of terminations resulting from reduction in workforce.

I would have also contested your filing as well. You resigned voluntarily, albeit for a noble reason, but that wasn't the choice of Ninde. Sorry.

If I was the employer I would have filed an appeal too.  You were not laid off, or fired from your job you left it on your own free will.

Typically a person is not eligible to collect unemployment if they left a job of thier own free will.  If you needed time off you could submit a leave through FMLA.  Which is unpaid.

get a lawyer.

From your report, I doubt you worked at getting a discrimination lawyer.

There is sufficent stuff in your report that if it had been my wife that got the same treatment, we would be able to shut them down at least at the location... or potgentially get compensation that matchs or exceeds unemployment.
