I am requesting assistance on the above referenced matter with the court system in Camden, NJ. I have relocated to NC since March 2003 due to a job transfer. The court system continues to collect through a wage execution on a child support arrears which has been fully paid and owes me at least $334.15 in over payments made through this execution and tax interception.

I have contacted them many times and their superiors on this and no one seems to care since I live 500 miles away from NJ and it is difficult to personally take care of this matter. I can supply you with more details on this matter upon your request. I have also tried to file a contempt for not letting me see or communicate with the kids. And what does the court says, "You need to drive up and file a motion which causes more money and travel expenses" This is ridiculous. To this date I still do not get to see the kids or talk to them due to my ex spouse stubborness and unwillingness to cooperate and I still continue to pay on arrears over paid to the account. I have not received my over paid refund.

Same problem with Cumberland County New Jersey!!

I have a problem like yours in Cumberland County New Jersey with paying $6,000.00 over for my ex who collected welfare by fraud since she abandonded our daughter when she was 6 months old. I live in Tennessee and only have arrears which NJ makes sure to harrass me over even though I can prove my case they don't want to allow it to be heard. There is a REAL PROBLEM with New Jersey and their Support Enforcement Unit. They actually told me to take this as a lesson learned and to just pay my last $90 to sastify my case and move on.... Of course me being a bit short tempered I laughed and told the I'm not paying s**t until the laws abid to both sides and not just the females when in court. I really would like to chat about your case and mine so please contact me.. Maybe two heads will be better than one and we can both figure out a plan which will work :)

First of all, do not listen to the advice from the last person who advised you not to pay the arrears. Support orders are exactly that: orders of the court. Failure to pay can result in your property being taken, contempt charges being brought against you or other consequence. In some states, failure to pay court orders support can even be grounds for suspension of a professional license such as a doctor's license to practice medicine.

If cirucmstances have changed, it is up to you to bring a proper motion before the court and give you ex notice of a hearing and an opportunity to be heard. A person acting as their own attorney has the same duty as an attonrey to know the law and proper court procedures. You can't just call up the court and expect them to help you. They cannot provide legal advice or practice law. You need to file a motion to stop the garnishment and back it up with evidence. It's not the Court's job to do this for you.

DO YOU HAVE VISITATION WITH THE CHILDREN, STIPULATED BY THE COURT?

IF YOU DO, AND IF YOUR VISITATION ALLOWS FOR YOU TO TRANSPORT YOUR KIDS TO YOUR NEW STATE, THEN YOU HAVE TO BUILD A CASE AROUND THE FACT THAT THE EX IS ALIENATING THE CHILDREN FROM YOU AND THAT SHE SUFFERS FROM THE SYNDROME CALLED "PARENTAL ALIENATION SYNDROME" OR "PAS" FOR SHORT.

FOR THIS, YOU MUST HIRE A GOOD LAWYER WHO HAS DONE THESE TYPES OF CASES IN THE PAST.
