I purchased a 2004 Nissan Altima on April 29, 2004 trading in a 2002 Roush mustang. When I financed the Nissan, I was upside down on the financing and was told by Anthony, the finance person that I had to purchase a Security + Plus and Maintenance + Plus agreements (extended warranties).

I never keep a car very long, usually 18-24 months, so on May 25, 2004 I called the dealership and was told to send them a letter stating my wishes. I sent a certified letter to cancel the extended warranties asking that my loan be credited for the purchase amount of the warranties. According to Nissan policy, if the warranty is cancelled within 30 days, the loan is credited the purchase amount, less $35.00 processing fee. Nothing was ever done to cancel the policy nor was my account ever credited.

I traded the Nissan in on July 1, 2005 and on August 1, 2005, I again called North Texas Nissan to attempt to get my refund. I was told to come to the dealership and bring the proof that I had traded in the car. I on that day took everything to North Texas Nissan and was told I would receive a refund in 4-6 weeks. The end of August I called Sean Hodges at the dealership, told him that I was moving to Alabama and he told me the refund would take 12 weeks. I followed up several times with Amanda Burkhart at the dealership, but was getting nowhere.

On November 2, 2005 I initially phoned the Nissan corporate offices in California and called them almost daily until on November 20, 2005 I received a prorated refund to July 1, 2005. Corporate told me that the dealership would be responsible for the remainder. I spoke again to Sean Hodges and he told me that all I was getting was what Nissan had refunded. He said that he did not accept letters and he would only cancel a policy when someone came to the dealership in person.

I have spoken with either Sean or Amanda at North Texas Nissan at least a dozen times and I was never told this. Sean has been very hostile when I have spoken with him and this is a ripoff. I told him that if I had ever planned to do business with Nissan again, that my experience of having to deal with him changed my mind.

This type of action is a scam and ripoff and should not be tolerated by hard working individuals.

I had the very unfortunate oppurtunity to do bussiness with these crooks. I was purchasing a 2005 Nissan Altima from them or so I thought. I will not get in to all of the details hear but I will say that I was in the car for two mounths and getting concerned dou to the fact that I had yet to receive a payment book from the bank. I was about to call them to see whatto do when I was called by them and told that I needed to bring them an additional $1000 and that my payments would double.

It did not matter to them that I had a contract already. I am notthe type to deal with this treatment so I went out and got a differant car and and took theirs back to them. When I returned the car to Mr. Hodges and asked for my deposit back he told me the I would not get it back because they were charging me for renting the car. He then told me that if I did not leave he would call the Police and have me arested. I as a man with some wit left but went straight to the Corith Police Department and told them what happened.

They Laughed and told me I did not need to leave because that dealership pulls that so often that they no longer asnswer calls there. In that officers word, they deserve what ever happens to them and they will not waist any assets to protect them from there own dishonesty. I was fortunate that I saw what was going on and got the heck out of it and that I had a banker that entered the deposit as a fraudulent draft and gave me my money back, but I know I was lucky. I turned to the BBB in my case and found them to be equaly crooked. They took the dealerships word over mine, the bank, and the Police and at lasr check still show that sespool in good standings.

It seems that a lot of times when a customer has negative equity the dealership will add on additional warranties to the contract so the customer won't have to put down an excessive amount of money. It does seem that you could have gotten your warranties refunded a little faster from the dealership, but that's probably your negative equity they are refunding to you. All in all you probably didn't get the bad deal you think you did. Maybe a little frustrating, but not a bad deal.

Luanne many car dealer's F&I clowns tell car buyers that they have to purchase Security + Plus and Maintenance + Plus agreements (extended warranties). .

They sometimes put fear in the buyer that they will not get financed if they do not buy that extra crap. Many only tell car buyers this crap so they can increase the size of their next week's pay check. They are fast to take your money, but when its time for you to get some money from then they take for EVER to give it back.

The civil order relates to restitution for payments made by consumers for fictitious extended warranties and registration services paid for, but not received. The restitution order also covers reimbursements of credit report costs to victims named in the criminal case.

My big beef is that I can't find any other AG's office in this country that spanks car dealers. If they do I can't find any that have any posted proof that they car spanking car dealers that have fishy ways of doing business.

Many car dealer employees try to come to this web site and try to defend their deceptive ways. Makes me sick!

They are fast to take your money, but when its time for you to get some money from then they take for EVER to give it back. Want proof as to how hard a guy had to work to get his $2000 back ?

I would think that you car buyers out there would be upset that you can't find very many AG's out there that spank car dealers. What a RIP!

You will never get this kind of inside info from NO NEWSPAPER. many all love the big advertising money they get from the car dealers that Rip you OFF.
