Same story. I was told I would be saving MUCHO DINERO by switching to the "Norvergence solution" and was caught in the trap. I believed the lease agreement was for the complete system. After I filled out the application and lease agreement, which I was told was non-binding until receiving the Miracle Matrix box, I waited through the PHASES to see if they would "accept" me. I was then hounded by Norvergence reps until I agreed in May.
Five days later, the Matrix box was installed and two days later the lease was sold to Popular Leasing. The cell phones never came, never got the T1 or phone or internet service, all supposed to come in 3 weeks. About 6 weeks later, I got through to Norvergence reps only 2 times, after hours holding on the phone. They had every excuse in the book of why I didn't receive anything...they're rapidly expanding and cannot keep up, the phones I ordered weren't available, and more BS.
I told them to get the box out of my office and I wasn't paying a dime and they said no sorry and kissed my @$$ on the phone for an hour, asking me to please pay and they'd reimburse me. I didn't and funny, my first bill was due after Norv. was out of business.
A few days later I received the letter from Popular informing me of the bankruptsy and that I was still responsible for the lease. I told them no way and get the box out, and now I'm getting bills with late fees. I contacted a few other communication co's out of curiosity and they couldn't use the box, and even XO said they couldn't help us and that they wouldn't pay for the lease either. They can take all of us to court but what would a judge think when we're getting nothing, regardless of the WORDING of the agreement.
Popular leasing- clearly in on the scam. I really would like to know what they paid for the leases. Why would they buy a lease in May from a company who wasn't paying them, forcing them into bankruptsy only a month later. They couldn't collect from Norvergence and they won't collect from us, but they won't put me out of business. Everyone needs to contact their State Attorney General and the FCC and file reports, the more they hear, the more they will listen-DO IT.
The bankrupsty judge voided all the Norvergence leases for their offices, the dept. of labor is helping their employees get compensated for not being paid (for ripping people off), but who will help HONEST business owners like us for the situation that Norvergence has put us in. I'm not going to pay for what I was supposed to receive but didn't, because I still have to pay for what I already had or I'd be paying MUCHO DINERO.

Sounds so familiar

Our company is in the same position. Equipment was delivered and then that was where it stopped. Could not get a hold of anyone at norvergence. By phone fax or email. A few weeks later they go Belly-up. Now it has only been 3 months since my lease was started and the Leasing company Wells Fargo has already filed a suit to collect the balance of the lease.
I am not Lawyer but this seems a little fishy. I have never seen a bank file suit against some one for be in default for 2 months.
I now have less than 20 days to respond to the suit which was filed in an Iowa court to fight this. Is this even legal?
Has anyone else been served papers from the court claiming that they have breeched there contract with the leasing company and the leasing company is demanding the lease be paid in full?
