I resigned from my job of 9 Years on October 10th 2006 from Springs Global because of frustrations of my job, conflicks with Plant Manager and our jobs being taken to Brazil. I applied for unemployment compensation until my new job started in November or December of the same year. North Carolina refused me benefits because I was moving at the time I was first denied and I was late filing an appeal.

They took sides with the Springs Corp. and left me with nothing. I was out of work for 5 months because of problems with closing on the New warehouse that I was to begin work at. So I had to use my savings just to make ends meet. I've worked over 30 years in Textiles. I've never had to apply or draw from the NC unemployment system. I've always paid my taxes and supported the sytem that has now denied me all claim.

When it was time for me to be compensated I'm disallowed. I'm working now and supporting the very system again that denied me claim after 30 Years. What good is the system for the hard working individuals that don't ever sponge off the system and pay into it. What rights do we have, or who do we turn to when our time comes to receive.

I'm very disappointed in our government and the system. Ms. Webber of the ESC, I hope you got something out of this deal because you sure did cost me and my family a lot. This not only hurt my wallet but it hurt my heart more because I was loyal to this company by not missing a day, saving them money, meeting deliveries on time. I worked with them like a family. What did I get in return.

Unemployment is payable to people that are without work due to layoff or other disaster that is no fault of their own. You say that you voluntarily terminated. The state is correct in not allowing benefits without a waiting period because you voluntarily left the job.

Terry, I have never heard of anyone who quit a job being eligable for unemployment benefits in ANY state. So, I checked the NC EOC website, and sure enough, it plainly states that anyone who QUITS a job will be denied benefits. I don't know who told you differently, but I would wager it was NOT anyone at NC EOC.

Not a ripoff

You say that you were moving and that you were late in filing an appeal? Did you not update your address immediately? If not, then it is your own fault that you did not get your appeal filed in enough time.

I work in Human Resources. There are actually very few circumstances in which an individual can voluntarily resign from a job and receive compensation. Namely-hostile work environment (which DOES NOT include disagreeing with your superior), unsafe work environment, etc.

If it was that easy to get unemployment for voluntary resignation, I would suspect that half the workforce would be resigning and filing.

As stated above, in order to file and receive benefits, you must be available and actively seeking employment. Unemployment benefits are not there to be used as a bridge for leaving one job until another one starts.

Maybe next time you will think twice before resigning your job before you have another one ready to start immediately. I see no ripoff here.

By the way-I do not work for any employer or government agency in the State of North Carolina or any other state in the country.

If I had beat up the plant manager and been dismissed, I was told I would have been able to draw. Now what kind of system is that. You need to have your ducks in a row before you sound off or maybe you work for North Carolina Employment Security Commission. Maybe your one of those people I was referring to that sponge off the system and know just how to get around the system.

Read up on unemployment qualifications

You stated that you "resigned" from your job. Resigning, quitting, voluntarily leaving, being fired, etc. are NOT valid reasons for filing an unemployment claim. Unemployment insurance is awarded to those people who are laid off due to lack of work. Period. These people then must be available and actively seeking work during the period in which they are receiving unemployment benefits.

Your case is not a rip off, you simply did not meet the qualifications for receiving this benefit. Perhaps you should get your ducks in a row next time before "resigning" without first establishing an alternate method of income.
