It was November 2013 when a salesman from Retriever Merchant Solutions stopped into our shop to talk to us about the credit card machine that he could set us up with, get us a better rate and no contract. We listened unfortunately.
We we're a small family automostive repair business and were sceptical about anyone walking in to sell us products such as this. We ended up going over the merchant application with him, watching closely what he pointed out and that there was "No Contract". In fact we had asked him more than once about there being no contract just to be sure, he assured us that there was none.
Salesman, Luis Escobar had our application papers on a clipboard which didn't mean anything to us at the time. We filled out the information needed and signed where he pointed to, read as much of the teenie tiny small print as we could and it was a done deal. That day was November 8th.
Our new credit card machine came, we were checked out along with our shop by a man who would help us get set up to start processing, it all seemed to be going as it should.
On November 11th we received a letter from "Lease Finance Group LLC or NPC" reguarding our "Non Cancelable Equipment Finance Agreement". The letter told us that we had to maintain insurance covering the machine and if we don't comply, we'll be charged an additional fee of $4.95. Along with the letter was a copy of the hidden on the clipboard, Non-Cancellable Lease.
This so called agreement stated that we agreed to a 4 year lease with NPC/National Processing Company or Retriever Leasing Division. The lease also stated that we'll be charged $49.95 plus taxes which brought it to $55.46 a month. So far, we've paid roughly $1275.58 for a machine that is only worth $200.00 if that now.
I called the number on our lease last year because we were having trouble with the machine, and in reading the lease closely found that we were scammed big time.
I called the number on our lease, the man I talked to was rude and stated that I should have read the small print, why was I calling now and there is nothing I can do. If we cancel the lease we will have to pay for the months left in the lease.
Frustrated, I told him that the machine is only worth $200 and he rudely replied that NPC paid Retriever Merchant Solutions for the machine and our account, we are repaying NPC now.
We closed our account with Retriever Merchant Solutions and that was easy because, with them we didn't have the contract. Next month will be our full 2nd year out of the four with NPC. This is so insane, how can these companies get away with this?
Just this week we received a letter from our credit card company, the letter states that the CC machine we're leasing isn't going to be compliant as it doesn't have a slot for CC with the chip in them. Our machine will not work after the 18th of October. We can get a new machine from our present company, no contract, $199.00 and it's ours, no lease.
I called NPC and had to leave a message, later a woman called stating that I had to call another number and they will give me another machine that is compliant. I asked her what if we don't want to continue with them, she stated I will have to call and they will tell me what will happen.
I haven't called. We will call to see what we're told about getting out of this lease, knowing that we'll be told that we owe another $2,000 which is insane. What can be done? We're trying to come up with a plan so we can just keep our business going with no interuption.
We'll contact our Attorney General Lori Swanson for her advice and help, see what possible suggestions we hear from others on this site. What a mess this is!!

We contacted Minnesota Attorney General Lori Swanson, sent a thick packet with all the proof we had. We sent photos of the contract and how it was presented to us with the words "NON-CANCELLABLE LEASE" hidden at the top because of the clip on the clipboard, how the number "48" was filled in later by the rep after we signed and so on and so on. Our AG (Attorney General) is a great lady and has a A#1 staff but all they can do I guess is write letters to NPC and Retriever to see if they will stop and let us out of the lease.
We received a call from the AG yesterday and she stated that NPC will be aggressively be going after our business by filing in New York. Our question is, "the scam happened in Minnesota and so how does that work? How can someone sue you in another state when the law was broken here, they scammed us here? If the judge is a real judge he would have it handled here, to us anyway". Does anyone have thoughts on that, any experience with this situation?
We plan to ask our attorney about this question and don't plan on paying them another dime. We went to our bank and put a stop payment on NPC and it works, of course then they sent the letter to our AG. NPC, for the last four months or so has sent the letters from our insurance company back, you know the letter that shows the machine is covered. Well, they send back the letters so they can charge you the extra $4.95 and then can charge the $60.61.
I can't believe that Retriever and NPC continually get away with this, they scammed my neice I found out and she ended up paying over $1,000.00 to get out of the lease. It's just freaken crazy, where is the help with scammers like these complanies? It's insane!

This is the same thing that happened to us. We were scammed by signing a lease for 5 years with the cost being $6000.00 for equipment that is only worth $200.00. We are close to the 5 years ending And will be out of this soon! i have read that when your term is up and cancel they "lease finance group" will claim they never get the equipment back or claim that it's not working. They will then try to get you for more money. Just looking for any further advise or help on this.
