Nu-Century, Inc. was ordered by Dept. of Labor to pay me owed past due wages by August of 2013.

To date, July 5, 2014, Nu-Century has refused to pay those back due wages, even though they agreed they would when notified by Dept. of Labor as to their error. If they will not pay employees monies owed to them, how do companies who hire them expect to be treated!!!

Richard,

Someone wants to work for your company and agrees to be a 1099 employee then gets let go and now wants to play the Dept. of Labor said so card.  You got paid for what you brought in and handsomely at that.  This is silly.  People wanting something that they did not earn.  How does anyone expect to get paid additional for something that they did not earn?  The dept of labor says you owe me this so it must be true?  So you go and put up a posting here and that is going to support your cause how?  You guys are all the same.  You were all hired as 1099 reps and when you made sales you were paid a very high rate of commission.  That was the deal that YOU agreed to and signed on for.  The Dept. of Labor judgement was under duress and for reasons you will never know my hand was forced to sign it.  That does not mean that i am guilty of anything.  Any of my staff that was employee's were not listed in this because they were paid.  You signed up to be a 1099 independent contractor and you got paid for your sales.  (i was even nice enough to help you out because you needed some ramp up money and i gave you three weeks of pay).  I guess the nice guy does finish last.  All that have posted in the past need to look at the contract you signed with us and realize that you were fully compensated for your contributions and nothing else should be expected.  What is this world coming to when you have and agreement signed by both parties and it is not good enough for the dept of labor and now you all want to piggy back on that.  You are damaging not only the companies reputation but the people that work here as well as any one else that could benefit from our services or employement. If you can proved that you were not a 1099 employee and that as a w2 we took taxes out please forward that to me and i will rectify that, but as the dept of labor told me "I know that car dealerships can get away with 1099 because they have lobbyists, but we have to crack down on someone and we got a call from a disgruntled former employee so we have to investigate."  Why even have a business if this is how the law helps the business community by allowing people to hop on a technicality to try and collect money that they know was never due to them in the first place.  What a shame.
