I am in the middle of foreclosure with this company. Does filing bankruptcy help straighten things out with them? I have all the money to catch up all my late payments but they continually mail me the money back asking for outrageous fees. Is there anyway to keep my house?

Hey Rachel.....To answer your question about filing bankruptsy.....chapter 11 is for businesses,13 is for reconstruction of your credit,and 7 is total amnesty...which is granted by the bankruptsy judge........
I was in a similar situation where I was on a HUD program for 3 years and Ocwen bought the loan from HUD and tried to accelerate the loan early....which they were supposed to follow what your origional trust states.....I went into lforclosure with them and in the middle of the forclosure they sold the loan to Fairbanks Capitol.another preditor.....
I contacted the Office of Thrift Supervision via e-mail and dealt with Dave Rollins...I received a letter back in about a month stating they would get some answers to my complaints within 30 days...well quess when I heard back from them?.......1 year later....
they harrassed me during my bankruptsy.sent mail etc....I am now fighting this with Fairbanks.......whom is now Select Portfolio Serviving....can one keep up?...
This is what I have learned.......You need to make your case to the Clerk of Superior court when you have your forclosure hearing.......this person is your best bet...if you have missed that then filing bankruptsy 13 will allow you to get caught up under the superision of the court.they will not get involved in this I assure you. They will only deal with the figures you are handeling...
Now,Ocwen filled 23,000. owinf for me with the bankruptsy court and during the bankruptsy the sent me a letter stating that I only owed 11,861.00 and would be happy to settle with me for 10% of that which would have been around 3,000.
My bankruptsy attorney said he would pay it if he could get them to confirm this of course he couldn't get them to do so even though it was written on their letter head etc....13 will allow yu to get caught up....and you can file that 2 times if you can't carry it for the time specified and they can not take your home during this time....now if you can't carry it either time then before they sell your property on the court house steps you can roll this over to a ch.7 upo which if you are not caught up on your payments then you will have about 45 days until final forclosure....and I might add...once you roll this over to a 7 they have to start forclosure proceedings all over again....
the benefit of this is that you now will have another forclosure hearing and then you take your documentation to the the hearing and state your complaint to the clerk who is acting as judge.......tell them you are a victum to predatory lending....and you have been trying to get this streight.....
I am stilll fighting this with Fairbanks.....I've been thru 2 ch 13 and rolled over to a 7 and have fought for the last 6-7 years.....I told them they wouldn't get a dime until they got the figures right....DON'T LET THEM SCARE YOU!!! It is plain out right manipulation.....and pray!

You know what I'm talking about. The federal report that shows monies collected but not accounted for in regards to your 'former employer', the legal fees that are deducted, but when the payment schedule is filed, you CANNOT FIND accounted for? legal fees your accountant in CIRCUIT COURT denies would EVER charge?
Why don't you mention the 'fees' that in court no longer exist? The lack of WITNESSES that Ocwen has when they go to court? Seems the accountant knows nothing, and no one backs up Ocwen in COURT. Maybe afraid employees might 'spill the beans' on how checks are 'parred down' in accounting sheets, let's say about a third or more so you can collect it TWICE.
Why don't you call me, and tell me why you won't use your name, and defend Ocwen in court at any time? You hid alot of 'fees' thru Ocwen. You are an OWNER in Ocwen's corporate books. You promised to call in 1999.
No matter, your stock is dropping, you have NUMEROUS unpaid bills that you were supposed to pay on property taxes from escrow accounts, but didn't so you could collect interest on the owner's payments AND bill owners for high interest by the city! Another 'double collection' process.
And then let's not talk about all the judgments AGAINST Ocwen get one appeal, and another appeal, and yet another appeal, spending investor's money like water on 'debt collection' attornies.
Then there's the houses that you VIOLATED HUD CONTRACTS WITH. And the contracts you mailed to people that you hoped took away their rights that HUD was supposed to protect.
Such as HIDING insurance monies for repairs, collecting interest on them, and letting houses that you FAILED to honor the HUD repair/contract clause get torn down as a result!
Why doesn't anyone seem to know where the insurance monies really go to when you're called?
But telling the owners it's Ocwen's insurance money. when confronted, because the State of Michigan says your insurance company isn't even licensed to be in MICHIGAN. So Ocwen is safe because Ocwen is not licensed as a 'forced' insurance company?
What's THAT about? So folks, know if you ever NEED the insurance, though YOU pay the high premium, all the money DOESN"T go into repairs, but in an 'account', and you're told the "down payment" that a contractor requires,is the FULL PAYMENT. Somehow, Ocwen "forgets" to tell you that there's a second, much larger payment that goes into an account! That only comes up when the Feds talk to Ocwen. Makes it easier for Ocwen to take money that isn't theirs?
If Ocwen owners were not hiding behind a corporate designation, and various "corporations" that "Collect fees", the owners would be in jail. Isn't corporate law wonderful in protecting unlawful acts from becoming criminal charges?
In time, dear 'friend', in time..... but you're no ex-employee. An ex-employee wouldn't lie for you! Because MOST EMPLOYEES make BAD LIARS in court, you hire ONE 'accountant', who makes claims that she can NEVER verify, any more than Ocwen is willing to allow.
However, taking over thirty grand, and claiming Ocwen gets to keep it, was a little too much for the jury to handle.
Just wait til the COURTS hear about Ocwen's latest! Ocwen owners wanted the appeal... now you'll GET your appeal with the latest 'move' Ocwen made... guess no OWNERS of OCWEN will be in court, as usual. You'll send an 'accountant' maybe? And a sheet for a 'property evaluation' that's almost half of what Ocwen claimed just after the fire? And more excuses why we can't proceed in court, and have to come back another day, etc.
Boy, Ocwen attornies know how to play! Right into a court fine, but what do 'debt collection' attornies care? They're not there by 'reputation', but as a buffer between Ocwen owners and the law.

I know that Ocwen is nothing but a but a bunch of scam artists trying to steal peoples homes from them. I did talk to several lawyers about filing bankruptcy and they were all VERY familiar with Ocwen and the shady way they do business. I am glad to report that I did not have to file for bankruptcy. After contacting the Office for thrift supervision, the local clerk of the court, and the lawyer that filed the foreclosure papers for Ocwen, I "out of the blue" got a phone call from Ocwen's****.> SO EX-TOP DOG SCUM YOU LISTEN UP -- TAKE OFF YOUR HAT AND SHOVE IT UP YOUR @#$!!! I HOPE YOU ROT IN @#$% WITH THE REST OF THE OCWEN SCUM!!!!!!!!!
