Delta Funding wrote a $60,000 mortgage on my mother's and father's homein 1999 at 13.65% promising to rewrite the loan in 2 years or less if all payments were made on-time. The interest rate was to be dropped to a decent rate at that time.

That was seven years ago. They have not rewritten the mortgage noe lowered the interest rate as promised. I have been trying for more than four years to get another mortgage with another mortgage company and can't even get the proper information to have another company even consider remortgaging the property. My father is 78 years old, my mother 75 years old. I can't even get the name of the title company that originated the loan in 1999 from either Delta Funding or Ocwen who is now doing the servicing for Delta.

They just keep passing the buck back to the other when asked for any information or the information is just never given. The property is going to be lost to back taxes if I can't get someone else to refinance ASAP. Before this mortgage fiasco, both my father and mother had AAA credit ratings, now they can't get any credit. They had previously paid off two other mortgages on this property and didn't owe a dime on it. When my mother took sick, Delta and subsequently Ocwen has ruined everything. My parents will be homeless after living in the same property for over 40 years.

What if anything can be done??

I am sure sorry to hear about that. Was their promise to rerate this loan on any of the original paperwork, or do you have a note - any conversations overheard by anyone?

If you do have proof of any kind, contact your state's Attorney General. It's that offices job to protect the residents against this type of crime.

If you don't have any proof, given the number of complaints about Ocwen on here and the governments' pursuit of them - it's pretty safe to say this isn't a forthright company.

If your parents are making payments on time, what about refinancing with a prime lender?

As far as getting the title co' info - just go to the clerk of courts (or the county recorder - whatever they call it in your county) and ask to look at the mortgage and property records on file. This falls under the Sunshine act. They have to let you see it and the mortgage will have the stamp of the title co' that filed it.

You will see what's filed too - and look at the paperwork to see if your folks gave written permission for Delta Funding to release any information about the loan to a third party for servicing. I doubt that they would have agreed to this. But either way - I suggest contacting the state AG right away...
