OES/MBC/Jeremy Lucas Misrepresented merchandise Yarmouth, Nova Scotia Canada

I did all the homework to check out this Canadian company who does business within the USA also and still got burnt. I just took my first hard hit in the business and bought 400 closeout purses. The lot was not manifested but I was told in writing that there was a good mix of brands,styles and colors. Also not guaranteed but estimated in writing that 100 piece lots normally retail @ $6500.00. My four hundred piece lot should have a retail value of approximately $26,00.00. It was just a bit over half. Most came with original retail tags. I liked the brand examples he said I should expect to see and was willing to accept the cheaper brands with some of the higher dollar ones.

When the lot arrived we had about 65% to 70% of one same lower end brand and the rest of the brands were also lower end and mixed. We received none of the more popular. Not one. Got me!

He is denying fault in anything and has no intention on taking his merchandise back. I know that working through the court system will not result in any concessions any time soon but I am a very small business and this hurt enough to do all I can to expose and possibly file suit. I am willing to spend time and resources for the principle of the matter.

His denials and excuses mainly revolve around not ever guaranteeing anything. To be fair, He is correct, he never guaranteed anything which is acceptable when buying closeout merchandise however his implications and inferences as to what I should expect as far as mix of style, brand and retail value are very specific, in writing and many of my associates agree are plainly misleading.

He does not answer phone calls and after a few emails trying to justify his tactics and avoid an amicable settlement he is no longer responding to emails.
