Due to the economic hardships in Florida right now my husband and I have fallen behind on our payments. Before we started to fall behind and realized our hardship could possibly affect our mortgage, we contacted Option 1 to remodify our mortgage. We started to contact them in November of last year 07, we failed to hear from them about whether they ever recieved our information; however they were always happy to ask when we would make our payment, and consistently stated that another department would contact us. This has gone on, and on, and being ignorant homeowners we listened to Option 1, and were waiting for someone to contact us. As of March we were unable to make a payment, and the same with April; however we were served with foreclosure papers from Option 1 in May. The most interesting fact of all of this, is that we were talking with Option 1 today, to try to work something out to keep our home, and when we asked if they ever recieved our remodification packet, and letter of harship, along with all our bank account statements, etc., they said that they received all of that information on March 18th, but no one ever contacted us about that. What happened to before we were served our foreclosure papers, and aksed over and over again, where is our packet. Our response, I am sorry but we do not have any information pertaining to that, and can you make a payment. Now we are being told that a remodifiaction is seperate forms from what we were originally told.Is that legal? Can someone please explain to me why we attempted several times to ask for help, and they recieved it, ignored it, and then served us with foreclosure papers? Ourtime is running out, we have 20 days to respond, and I am at a loss for words. What is this world coming to? I am told that Option 1 has class action lawsuits filed againts them. I was told this morning that Option 1 made our appraisal go over just a bit so that they could secure our loan, and lend to us. I have so many questions, but do not have the funds to seek counsel at this time.
Each time we approach Option 1, they only want to know when their monies will be paid. Are there others out there such as ourselves? If someone would be so kind as to contact me @ freesoul3334@yahoo.com if you are in simliar circumstances, or can lead me in a direction that I may not be aware of I would greatly appreciate it.
