Complaint Description:
I received an offer from OralBright in my email and was told that I could try their product if I paid $4.87 for the shipping. I did this in good faith and received the package and tried it which was basically worthless. I never ok'd OralBright to Charge my credit card for ANY funds other than the $4.87. I received another package from them without a request from me and have shipped the product back. I received another kit from them and shipped it back. I received my credit card statement which showed that OralBright had charged my account for $49.95 twice. I called their numbers from my credit card statement--neither number allowed me to speak with anyone. There number gave another number which was 888-298-1381 which not only did I call but my credit card company (Chase Visa) also called them while I was on the phone. When you chose to speak with someone you would hear about 30 seconds worth of music then the phone would go dead. I did get an answering machine on one of their extensions and left a message in which they did not respond to. I left multiple emails which they did not respond to. They make it impossible for anyone to directly contact them so they can continue to charge the individual for their worthless product. I have put the charges into dispute with the credit card company and they say that anyone that disputes their charges will have to pay an extra 10% of the total value of their product at what ever they consider retail value. They say that if you don't accept their product that is sent to you through the mail you also will have to pay $30.00 per returned item for them to destroy the product. If this isn't illegal I would like to know why it isn't? It is a strong arm tactic of a company that takes advantage of trusting people. They force anyone that falls for their trial kit offer to continue to accept their product or else they will force even more financial burdens upon the individual. The mafia of the early 1900's could have taken lessons from the company. I am asking that anyone that will take on this organization of thieves to help me and any future victims to get out from under their threats.

I went to Oral Bright's website and found the following statements, which were clearly written in the Terms and Conditions page.

By accepting the trial offer:

You agree to purchase 4 additional treatments at the discounted price of $49.95 each (that is 50% of the minimum standard price of $99.95 charged by most dentists) for a total purchase price of $199.80. For your convenience, we have divided the purchase into 4 interest free payments of $49.95 that will automatically deducted from the credit card on file.

Through this discount program you will save over $299.00 off the regular price charged by dentists.

We are so sure that you will love the results of the free treatment that we give you 15 days to change your mind. E-mail us at cancel@oralbright.com anytime before the 15th day of your original order and we will cancel the entire order. (Note: there is no refund on shipping & handling charges of $1.97 per treatment)

The billing will be as follows: On the 15th day after you signed up for the free trial, the first payment of $49.95 will be billed and one treatment will be shipped. The remaining payments and shipments will occur every 30 days.

Delivery:

Please allow 7 days to receive your treatment after your card has been billed. If you do not receive your trial treatment within 7 days of purchase, please notify us by phone 877.672.5548 or e-mail: members@oralbright.com. One of our product specialists will be happy to assist you. We cannot be held responsible for errors in delivery addresses or not being notified of missing packages.

Refunds:

We will gladly cancel your order anytime before your card is billed for the first payment. Once your card is billed, the product is shipped within 24 business hours and we are unable to accept return of the product and therefore are unable to issue refunds.

Returns:

In compliance with clean health practices, shipping oral hygiene products that have previously been distributed to clients is prohibited. Therefore, we are unable to accept returns of any kind. Treatments returned to us must be destroyed. A $30.00 destruction fee will be assessed to all returned treatments.

TRANSACTION DISPUTE (CHARGE-BACK) POLICY In the event that a customer initiates a transaction dispute (typically with their creditor/issuing bank) and this dispute is later rejected in favor of the merchant, customer agrees and authorizes Oralbright to bill them for "transaction dispute resolution fees". These fees shall be no less than 10% of the total disputed transaction amount, with a $25.00 minimum.


You signed up for a service without reading all the posted conditions regarding the service. Everything you claim to be a ripoff is plainly disclosed.
