Contractor complete entire landscape job except connecting drain system through the front yard to the street curb. I withheld $1000 final payment until they completed the job.
Over 90 days there were many "collection" calls. Each time I told them I would pay them when they connected my drain to the street, as per the contract.
One time they did respond with a contractor who did a concrete coring through the curb - but on the wrong side of the house. Then I received more collection calls. Each time I told them the same story.
Finally the owner called and I told him the story as well. He did respond by sending a crew the next day and they completed the job. I verified it was completed that evening and the next day I handed him a check for payment of the withheld amount.
He provided me with a conditional release form that was contingent on the check clearing, which it did.
Several months later when I sold my house, the title company reported a mechanics lien was filed by the owner on the same day I paid him. Further, the title company would not accept the conditional release he gave me.
I have been trying to get a release of mechanics lien for over a week. He finally sent one to escrow, but it had the wrong address. I'm now chasing him down to try to get a corrected one so my escrow closing will not be delayed.
Pacific Pools & Patios has very little internal controls to make sure customer compaints are processed and resolved promptly. They had no right to lien my property in the first place since the contract had not been fulfilled. But he filed the lien anyway.
I would recommend that you stay away from this firm. They did good work, but their internal controls are less than satisfactory and their customer service stinks.
