I need to know my rights and what I can do. The Law Office of Patrick Corbett, 716-681-3361. Have been contacting and threatening me. I owe for a payday loan with Check-N-Go, but I owe $740. Patrick Corbett is trying to collect $1800, then he knocked it down to around $900. Bottom-line, I don't make a lot of money. I didn't know any better. So they threatened me. Told me to pay the entire amount within 30 days or they'd file charges against me. I gave them my bank account info. Mind you, I told him the money would not be in my account on April 30th. He said that was fine, that I am allowed a bounced check. He then said call back in May with my Debit Card info, and they would debit May 15. I had every intention of paying that on the 15th, but I didn't have the money come the 15th. They then called me at work the morning of the 16th and threatened to have me arrested for bouncing a check twice across State lines (I live in MD). I was pleading and crying asking if I could please pay like $200 a month (that is what I can afford). They said if I didn't come up with $500 by COB they were pressing charges and I would be arrested. I was crying and telling them I am a single mom of a disabled child. They were rude, did not care and hung up on me!

Since Monday, they have left 2 messages on my home phone. I have not listened because it will upset me.

Should I change my telephone number? They are harassing me. And I fear they will start back calling my job and they have called family. What are my rights? I KNOW I owe, $740, but why can't I work out an affordable payment plan?

I know for a fact that you can not be arrested or have charges filed against for this type of debt.
I have had this happen to me recently and I have turned the tables on this type of people. I had another cash till payday place try this. I got at least 30-40 harassing phone calls from another cash till payday (which i am not allowed to mention their name). And I sued them for this is, it took almost a year with the back and forth and the counter suit they filed against me. But I have a fabulous attorney that specializes it this. And he won my case against them.

You look up the FDCPA (federal debt consumer privacy act) you will see what they can and cannot do. I would seriously not let them get under your skin. That is what they prey on and from what you have written that is what has happened. Don't give them your credit card information. From past experiences they would probably take more than the agreed up amount.

Also please please get the agreement in writing before you send any money. This way if they try and take more than the agreed upon amount you can get them for breech of contract because you have it in writing.

You can also do a search on the internet for an attorney who specializes in these types of cases, and talk to the about your situation. That is how i found my attorney. And trust me he is great. I never have to pay him anything. the companies that he sues pays he fees.
My attorney has settled 6 cases for me so far. And i have received $6100 from these harassing phone calls from collection agencies.

It is agaisnt the law for them to threaten to file charges or arrest you over a debt. Steve from flordia gives people good advise regarding these scum bottom feeders. I received information from my state attorney general office, regarding dept collection.

It is unlawful for them to threaten to arrest you or file charges they cannot due this there is no jail for people who have fallen behind on there payments. This is just a simple tactic to try to get you to pay. But they aren't allowed to do this.

These scum try pull anything to get u to pay but threatening to arrest you or to file charges they have crossed the line. I have had problems when I couldn't pay on a dept of mine, but no collector has threaten to arrest me or file charges.

Just complain to your attorney general office, its time for all of us who have been bullied or abused from these bottom feeder scum to make there life like hell for what the pain & abuse they have caused us for no reason.

Its sad when people lose there job & can't pay there depts, but to make the problem worse we have to put up with these abusive collectors.

Wait for steve from flordia he usually helps people who are in these bad situation's.

I used to work for Check n' Go, actually their corporate office - CNG Financial - and I'm surprised to hear that it's even gone as far as them planning legal action against you. Granted, I haven't worked there for about 8 years, but when I was there, part of the "deal" about getting a payday loan was that they couldn't file legal action against you.

I'm guessing that it went into collections (that was when you should have set up a payment plan - they would have been glad to do it.) At this point, it's gone further and now the lawyer is willing to take a settlement (hence the $1800 to $900 drop).

Ignoring his calls won't help. The next step is filing a suit against you for the amount borrowed, plus any fees they want to tack on. You CANNOT be arrested for this debt, so ignore that...its just empty threats. He's trying to scare you, and apparently its working. All they can do is file a suit against you for the money.

If you don't appear in court, they will win by default and then you'll have to pay the debt regardless. If you don't pay it then, they could garnish your wages.

I seriously doubt it will go this far, because I don't think Check n' Go is interested in pursuing a court case. I could be wrong though, so next time he calls, tell him that you'll pay $200 a month, period. That's all you can afford. If he balks at that, tell him he can take you to court. Be firm and don't let him harass you. Good luck.
