So are not upset that you were being served with a Subpoena, just that it was done at 6:20am. Hmmmm...Perhaps they couldn't get you at any other time..perhaps you have been avoiding them.

- That "answer" was wrong(or at least not complete).  Not all jurisdictions require you to be served by the Sheriff's Department. 

There are laws concerning when a collector or process server can come to your home and what methods they can use to attempt to serve you.
- Yes there are laws.  But as far as I am aware, serving you at your known place of residence is the one universal location that every jurisdiction allows.  Can you point to a specific law that says they can only serve you between 8am and 9pm?

Because here is the Texas Rule of Civil Procedure.  The bolded parts are of what may be particular interest to you.  In short these state that any person over 18 who is not a party to the suit can serve process, it also states that a process server must first attempt to serve you personally at places you are known to be(such as your house).  There is nothing I can find that states they can't do it before 8am.

Rule 106. Method of Service
Unless the citation or an order of the court otherwise directs, the citation shall be served by any person authorized by Rule 103 by delivering to the defendant, in person, a true copy of the citation with the date of delivery endorsed thereon with a copy of the petition attached thereto, or
mailing to the defendant by registered or certified mail, return receipt requested, a true copy of the citation with a copy of the petition attached thereto.
Upon motion supported by affidavit stating the location of the defendant s usual place of business or usual place of abode or other place where the defendant can probably be found and stating specifically the facts showing that service has been attempted under either (a)(I) .......
 
Rule 176.5 Service.
Manner of Service. A subpoena may be served at any place within the State of Texas by any sheriff or constable of the State of Texas, or any person who is not a party and is 18 years of age or older. A subpoena must be served by delivering a copy to the witness and tendering to that person any fees required by law. If the witness is a party and is represented by an attorney of record in the proceeding, the subpoena may be served on the witnesss attorney of record.
Proof of Service. Proof of service must be made by filing either:
the witnesss signed written memorandum attached to the subpoena showing that the witness accepted the subpoena; or
a statement by the person who made the service stating the date, time, and manner of service, and the name of the person served.

If they are are attempting to serve you with "fake" court documents that is one thing..and yes violations of the Fair Debt Collection Practices Act(FDCPA).  But before you try to claim invalid service and use that as a reason why you didn't show up in court.  You better be very sure there are laws that says serving you at 6:20 in the morning is not allowed.

You may want to read texas law a little closer. The only prohibition on process servers is they cannot deliver on sundays. Its perfectly legal to try and deliver it to you at odd hours. They will keep trying. You may as well acept the subpeona, if you continue to dodge it they will just file a motion with the judge to file it in the newspaper and use that as notification. It sounds to me like you know there's a debt and you are dodging it. Otherwise, why wouldn't you answer your door? Especially if you noticed it was a delivery person.

You advice to make.A note of everything is good advice, but this sounds like a normal process service situation. They wil often lie about who they are until they find the person and serve them. Again, no rip off here, just someone trying to dodge a bill collector. Don't dodge them too much, if they don't serve you and you don't go to court they will get their judgement against you for sure.
