Pekin Insurance co. Pekin adjustor Austin Lohmeier put my claim under fraud investigation for no apparent reason with no real communication with myself or company employees. This was all due to personal conflict. He apparently is too inexperienced to perform in a professional bussiness . Pekin Il. Illinois

I contracted Pekin insurance to insure my business for liabilty as well as property. Two of my service trucks were robbed and i called police and made loss claim . Pekin sent an adjustor out to take picture 1 month later. in the meantime we repaired all broken locks on vehicles.

I was indignant with poor resonse of adjustor, so he put me under fraud investigation. It is now over 3 monts later with no determination of my case. This company has no real basis to investigate us and haven't even communicated with us. They are prolonging this claimadjustment hoping i will go away.

The sad issue is I have to have insurance to be in business but what good is it. I have to pay my premiums on time or they cancel me. I have no such recoarse.

I am a 45 yr Claim Advocate working on both sides of the business as  Director of Claims of many national carriers and after retiurement I now Advocate for the policyholder. 

Always follow the conditions of the contract found inside each policy what to do when you have a claim. You filed the Polic Report for startes. Your right, Pekin is not overly experienced with high end adjusters, but a theft is a usual and normal thing they have handled thousands if not millions of.  Remember, they have no duty to you except to investigate and determine if your claim is valid and a covered loss.

The burden of proof rests with you. Of course they have a duty to exonnerate you as a suspect. Conditon #1 is you must cooperate fully with them. If they want your cell records you must produce them Condtion # 2 they can and may demand a EUO-Exam Under Oath per the policy and you must comply or lose your claim. Its just a way to lock you in on the facts so they can see if you have lied anywhere in the statement under oath, if so they can use it against you to deny the entire claim.  Condtion #3 File your Proof of Loss which they usually give you one of their own POL forms to complete. If not then they are dragging out the payment as the policy will stipulate that they must accpet or reject a POL within 30 days usually (some are 60 days). So the clock starts running once you send them a letter declaring it is your POL and attach a list of loss and damages or repair estimates to support your POL. They then are under the gun to accept or reject all or part of it. any REJECTOIN of your claim they must define each line item and why its being rejected. Even iof they dont ask for a POL, send one anyhow to start the clock.

Once you follow all the conditions required of you under the terms opf the policy "in case of loss" you can take that complaint up with the Dept of Insurance should they fail to follow the terms of their own policy timely. It places them in breach of their own contract and you will have put the monkey back on their shoulders and away from you. Filing the Proof of Loss with all support documents including the Police report again places the ball in their court. 

At this point they can drag this out until you comply with filing your POL even if its the same info they already have, but  you have not filed the damages under a notary declaring it to be your POL.

As Its been said by the Supreme Court recently, "The insurer attempts to convince you everything is covered when they sell you the policy, but after filing a claim, the adjuster trys to convince you nothing is covered!
