I thought I was SMART. I decided our credit card debt and usage was out of control and it was time to get with a service so we could just get it over with and live the good old-fashioned way - cash or don't buy it. 


So I did some research. I almost signed with another company but had my doubts, but then heard of CAREONE and they advertise that they're with the BBB-Better Business Bureau. They were extremely nice during the initial phase of recruiting. In fact, they stated that their fees were only $30/month for "administrative fees" which seemed much more reasonable than the thousands the other company wanted.

In reality, I was passed on to Persels & Associates, which is NOT BBB and they pay themselves a little more than $30/month. In fact, they pay themselves $30 a month X each creditor X 36+ months and it is all taken in the first year or so, not monthly as stated. As the majority of the payment amount pays Persels, they don't pay your creditors. 

I received a summons for a court hearing from my largest creditor and promptly faxed the papers to Persels whose representative stated that they would get out a cease and desist letter right away and have the attorney contact me "if necessary". Well my attorney did not contact me so I assumed I did not need to be present for that court hearing, but later received a letter granting a judgment for the full amount because I was not present.

While it is disclosed that a creditor could seek judgment against you, the contract states that your assigned "attorney" will work with you and give you legal advice should this happen. Since my attorney did not contact me I believed that the cease and desist letter they promised to mail handled the current situation. Clearly it did not but when I complained to Persels, they acted less than concerned and gave me a new attorney.

I have business reasons for not wanting a creditor potentially freezing my assets, wages, etc., over this credit card bill. I need to know what to expect. So just before Christmas 2009 I called my now 2nd "attorney". But when he didn't even know if an LLC could be liened by a creditor in Illinois,  I asked him if he was actually an attorney, so they assigned me to my third and current attorney. 

My third attorney now cannot give me a direct answer nor will she give me real advice, so I reluctantly came up with some money allocated for taxes to try to settle this account. On several occasions I stressed to her and her phone screeners that I would have to take tax money and I was not willing to do that if we could not come to a settlement agreement. Finally I was contacted by my attorney and told that I had until Jan 15, 2010 in which to accept one of 3 offers by the creditor, which incidentally, was about 90% of the balance-now increased by $2,000. I told her I would be in touch by the 15th then. So I did just that-contacted Persels on Jan 15 early in the day and authorized them to draw  money out of my account to begin one of the proposed payment plans with the creditor.

FOURTEEN DAYS LATER on Jan 29 Persels contacted me via email and told me that the settlement offer needed to be accepted and payment in the creditors pockets by Jan 15, and since the money wasn't deposited to my escrow account until Jan 21 the offer was now off the table. They actually implied that this was MY FAULT that the money was not deposited until then. They now have taken my money and did not pay my creditor and lost the settlement offer. Any new settlement offer is likely TO BE HIGHER than it was before--or so says my attorney. I'm not even sure if they're real attorneys.

As of today, my Persel's attorney has not called me back. I can only get a phone rep. This unfortunately is typical. If I terminate my agreement they will still take my money. All I can say is, I've been Ripped Off.

After reading a number of the complaints leveled at Care One, I am actually a little shocked. I just finished my 5 year plan and paid off $35k in debt. I do remember having some issues early on, as the negotiation phase was just beginning; i.e. credit cards still charging me fees for being late and not paying, however the moment the negotiations were finalized the fees disappeared and the payments stopped being for legal fees and began paying off the credit cards. Things have been moving so smoothly with Care One that I only checked in with them periodically. My last payment was submitted last night and though they took out the regular amount as they have for the past 5 years, I actually only owed half that on the remaining bill. I called and they said it was because they had not been updated by the credit card company since the bill was not due for a further two weeks. Over the phone they figured out based on my credit card statement exactly how much was still owed and were refunding me the difference in 7 working days. I was told that it was because they had not received the final statement from the credit card company as of yet. Honestly, the beginning is the rocky part, especially if your particular credit card companies will not negotiate. Once everything is finalized it worked, at least for me, without much trouble at all and I am now debt free. All this talk of not telling clients to look at their statements or not take calls from the creditors goes contrary to what I was told. I was told to tell the creditors I had signed up with a debt consolidation service and if they needed more information to call Care One. Within a week I was no longer getting calls. I remember specifically getting a call of exactly what the terms of the negotiations had been and paperwork to sign to agree to them myself came in the mail shortly afterwards. This company has been nothing but helpful and kept me out of the slippery slope of being able to just pay off minimum payments by replacing it with the ability to pay off the principle. I appreciate everything they have done and set my financial life back on course.

Well these guys are great and promising to help and not really doing anything.  I was once with them, and after doing research and having the threat of a judgement placed against me I dropped them as soon as I could.  You will probably want to contact an attorney about your financial issues.  Also you should write down every time you have spoken with Persels/Care One then write letters to your congressman, and Attorney General.
