The events that occured during the grievance process of my claim were unbelievable on the part of Pete Hayes. I call it extortion and after looking up the legal definition of extortion and the state statute, I feel it fits.
My case was made up of 2 totally separate parts, 1 being a contract issue for the back pay due to being wrongfully removed from the job, in violation of ADA rules.
The 2nd part is the legal violation itself, for which a complaint was filed separately with the USDOL / OFCCP as Tropicana /PepsiCo are federal contractors and I am a legally disabled Veteran.
A quick recap here. I was violated 2 years in a row while attempting to get accomodation for my rated disability they knew about when they hired me.
I made a written request for "reasonable accomodation" under the ADA, and Jenny Williams' response was to yank me off the job. That was her accomodation! 15 weeks lost time, 9 weeks lost pay!
Now for the alleged extortion by Pete Hayes. His settlement offer to my Teamsters 173 Business Agent, Robert Tuttle was that I had to drop my USDOL complaint in order to get my back pay.
The problem with this is that under the contract and the existing relationship and established procedure between the union and the company, I am already entitled to that back pay.
Therefore holding something of value to me against me in exchange for something of value to the company fits the description of extortion as I read the statute.
I need to bring this to the DA for prosecution.
Out of decency on my part, if the company would have just admitted the wrongdoing and made me whole on my lost wages, I surely would have dropped the complaint anyway. That's just the way I am, and they know this as I did it last year when they did the same thing to me!

Once again, my paycheck was shorted 4 hours. Is it really hard to give a person an accurate paycheck?
The worst part about it is the fear that the 4 hour loss will trigger a 1/2 occasion of absence which would count against me towards a reprimand and possibly even termination! Not to mention the 2 extra floating holidays we get Oct 1st for having no chargeable attendance issues.
Then, in addition, management does not even secure our paychecks and put them in the hand of the employee!
They are just tossed on the desk in the center office, and it is a self serve system for each employee to go in and get his/her own check!@
Does anyone else see a problem here?
Incompetence hard at work again!
