This writer changed a number of facts to better hide herself, her mother and her step-father who had years of family court experience on the receiving end, and she complains of me again, here on this site. The fee was not $5,000 and this client did all the case preparation herself only hiring me at the last minute to push her box of brochures into evidence. The case was one for relocation and hearsay ads for housing and potential jobs would never accomplish the client's goal of getting away from a litigious ex. I should have rejected this case as I do in most such situations.

Nonetheless, my approach at this last minute case was to have the client testify that she would agree to give the ex copious visitation which the judge said on the record he did not believe (incidentally later transferred to another court). This coupled with an inability to demonstrate better prospects in the new state doomed the case. This means managing her own case not knowing the law of relocation and hiring me to push it over the top with hearsay brochures was a losing proposition, hence the low, capped, fixed fee that included a trial which she could have rejected and walked away.

Another factor of circumstance is that in planning her own case, the client failed to develop a working relationship with any attorney while the ex capitalized on his relationship with his attorney. The ex is steadily winning by constant litigation while the client is handily outmaneuvered - hence this complaint that comes more than three years after the client terminated me and having complained on Avvo.

In a way, I am thrilled that this is my only rip-off report in 18 years of private practice with hundreds of clients. My clients generally do not plan their cases themselves and then retain counsel only for trial with their evidence, whatever that evidence is. My clients instead allow me to do the case planning and preparation hence the lack of rip-off reports under my name. My clients understand that evidence is prepared in light of the proper legal standard to be show to a family court judge who will agree with us. Any missing piece will yield failure. This client blames me, the lawyer for her lose three years ago.

I wish this client would stop these reports. The opponent is probably reading these and realizing that there is no hope for a pro se litigant in a family court.
