I purchased a transmission for my 94 Dodge Dakota back in 1-2002; it failed immediately. They told me that since I installed it myself the warranty was void. I told them that I was a degreed auto mechanic that specialized in drive-trains and was ASE Certified and that I knew exactly what they didn't replace in the transmission when it was supposedly rebuilt. They said, "you're in WA state aren't you? I replied "yes"; they said "well were in AZ and you can't do anything about it" and hung up.
I called the AZ Attorney Generals office and they told me to sue the Statutory Officer of the Corporation, not the "Owner" of the company. I called the Corporation Commission @ 602-542-3026 and found the Statutory Officer to be John W. Acer with an address of 5125 N 16th ST Phoenix, AZ 85016 Ph.602-248-0964
I called John W. Acer and told him my complaint and before I got off the phone with him my second line rang and it was Phoenix Hard Parts asking where I wanted my full refund sent to. I don't know who there Statutory Officer is now, but you can find out by calling the Corporation Commission at 602-542-3026.
To file a small claims court case, which I highly recommend if the Statutory Officer does not heed satisfactory results; you must file in the precinct where the Corporation is filed. In 2002 that was: Tolleson Precinct Maricopa Justice Courts Justice Joe Guzman 9550 W. Van Buren, #6 Tolleson, AZ 85353 623-936-1449
If you were ripped off by these crooks as I was don't let them get away with it; follow these steps.
1. Don't deal with them, that will only increase your grief.
2. Call the Corporation Commission and give them the name of the company that ripped you off and ask for the name, address and phone number of the Statutory Officer of the corporation.
3. Call the court and ask for the name address and phone number of the court having the jurisdiction over the address of the Statutory Officer.
4. Get a small claims form from that court and fill it out, be sure to include all moneys lost in the transaction; then call the Statutory Officer, give your complaint, tell them your ready to file with said court for said amount.
5. It worked for me, that's all I can say; I hope it works for you too.
