I thought that this information would be helpful to all that have received letters and/or phone calls from Plaza Associates, Jefferson Capital Systems LLC, First North American National Bank, or any other RJM supposed Collection Agency in an attempt to supposedly collect an outstanding debit. Especially if, like myself, you know that this debit has been resolved or is in dispute.

I received the same falsefied letter stating I owed an alleged debit that was paid off back in 1991, but they were stating that it had a balnce on it that has not shown on my credit report and no other proof of debit to give me other than the garabage they were trying to feed me over the phone. I guess they did not know that I am an ex legal credit collector myself who knows the laws of credit collections.

The next couple of paragraphs I copied directly from the Federal Trade Commision site ftc.gov/bcp/conline/pubs/credit/fdc.htm. You can go to the site and read the steps to take to sue these companies for Unfair and/or Fraudulent Collection practices or you can read what I have pasted below. Everyone must stop complaining because all they do is pay people to sit around and dispute what you are reporting on the Rip-off report. We must hit them where it counts, in their pockets or put them in jail. Do not pay a thing and instead have the court order them to pay you.

What can you do if you believe a debt collector violated the law?

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, you may recover money for the damages you suffered plus an additional amount up to $1,000. Court costs and attorney' s fees also can be recovered. A group of people also may sue a debt collector and recover money for damages up to $500,000, or one percent of the collector' s net worth, whichever is less.

Where can you report a debt collector for an alleged violation?

Report any problems you have with a debt collector to your state Attorney General' s office and the Federal Trade Commission. Many states have their own debt collection laws, and your Attorney General' s office can help you determine your rights.

Keep in mind that the FTC does absolutely ZERO individual enforcement. Filing a complaint with the FTC does nothing at all except add your complaint to a deatabase, and when the magic number of complaints are filed against the same entity, they do an investigation.

The FTC is a toothless tiger as far as getting justice for an individual. You must sue in civil court to recover those damages you quoted.

The Attorney General is not the point of contact for these complaints, as they do not have the jurisdiction to do anything. The function of the Attorney General is to provide legal counsel to other state agencies.

The only thing for an individual to do is to send a DEBT VALIDATION request as per your rights under the FDCPA. Clearly state that you dispute the debt and DEMAND to see something you signed to create the alleged debt, along with a complete account history. Inform them that the account history is imperative, as they need to prove in what state you allegedly opened the account for reasons of determining the statute of limitations.

Send this letter by certified mail, return reciept requested. Be sure to put the certified# on the letter itself, and keep a copy for your records.

Wait 30 days from the date the return reciept is signed and file your lawsuit on them for frivolous collections activity. And file criminal fraud charges on them as well as a complaint to the US Postal inspector for mail fraud.

Also inform them in writing that they will be billed for your time and expenses in dealing with any further communications at $60 an hour, and will be put into collections for such amounts until paid, and subsequent lawsuit will be filed for such charges, as they agreed to your terms when they continued to contact/harass you.

This works every time. You have to respond to BS with BS.
