I received a phone call from my brother indicated that John Sullivan, from John Powers & Sullivan, had contacted him looking for my ex-husband.  My brother advised that he did not live there and he was his ex-brother-in-law. Mr. Sullivan asked my brother to contact me as I was responsible for my ex-husband's debt.I contacted their number and was advised that I was being sued by two creditors. He stated that he would put an "administrative hold" on the lawsuit for 48 hours so I could gather some information and I could call him back.

I had received 3 letters, from PN Financial Inc, the previous week addressed to my ex-husband but I returned them. My ex-mother-in-law stated that she had also received a phone call a few weeks ago and was advised that she was responsible for her son's debt.

After doing some research on line, it sounds as this is the same scam that others have experienced. I called the phone number and left a message asking for proof of debt in writing, their bar license #, the default dates for both accounts and the case #. I also advised that I had filed a police report because I thought it might be a scam.

I have not heard back from the "law office" and this leads me to believe that it is a scam.

#1 Consumer Suggestion

PN Financial is a scam agency

AUTHOR: Larry - (USA)

POSTED: Thursday, December 31, 2009

I dealt with these guys back in October over a supposed 15k BofA Card debt.

First and foremost "John Sullivan" is not a registered attorney in Illinois (at least as of November 1, 2009). I have a letter from the Illinois Attorney Registration and Disciplinary Commission confirming this fact.  I doubt he's actually a real person. The owner of the company is Nelson Macwan.

Secondly PN Financial is NOT a law firm. They are a collection agency licensed with the State of Illinois and nowhere else. And the only court paperwork I've ever found from them on PACER or in State Court filings are from consumers suing them for multiple FDCPA violations.

You need to send them a written request for debt validation certified mail. More than likely this will go unanswered, but you need to do this to cover yourself in case these guys manage to sue you.

Then I'd complain in writing to the Illinois Attorney General, California Attorney General, and the Illinois Department of Professional Regulation (the bureaucracy that license collection agencies and theoretically disciplines them). These guys are begging to be shutdown and I really can't imagine why they haven't been.

You can also sue them under the FDCPA. The dunning / notification letters P.N. Financial sends out are rife with multiple violations of the FDCPA and are probably illegal in most states.

In my case, Nelson M. Macwan responded only to the Attorney General's complaint I filed against him, pleading that he himself had bought (and then tried to collect on) a fraudulent debt P.N. Financial had been sold and the collection activities would cease.
