PNC MORTGAGE CO NATIONAL CITY MORTGAGE PNC LIED, MISLED AND SOLD MY HOME VIOLATING MY RIGHTS WHILE I WAS IN BANKRUPTCY OHIO, Ohio

Last year on April 2011, i started falling behind in my mortgage payments.  Due to the economic crash last year.  My business dropped sales and struggled with my payments.  I contacted PNC and requested a loan modification application to lower my payments.

9 months later, i received a sale date and a denial of loan mod.  By this time i was in a bigger whole because not only did i still have a large mortgage payment but now i owed thousand of dollars in late fees.  I panicked and send them another application now i had very little time left due to my sale date.

I received a letter from PNC stating that they would review my application and will respond within 30 days. 3 days later i received another letter from PNC stating that there was no more time to review and foreclosure was going to proceed.  Not only did PNC state they were going to help me but instead proceeded with the sale date.

I had no other alternative but to file for chapter 13 to stop the sale.  I was able to stop the sale, but my nightmare was not over.  while i was in bankruptcy, PNC advised me they could not modify or even consider me for a loan modification while active in bankruptcy.  So I didn't follow the steps to complete my chapter 13.  As soon as i was dismissed by the trustee, my home has a new sale date. My loan was denied with no reason.

I was a disaster because my loan modification was denied, i has a 180 bar which means i could not file for bankruptcy again.  So i had my brother whom had 5% interest in the home file for bankruptcy to stop foreclosure.  Cal-Western sold my home while active in bankruptcy.  It took 3 months to resend my home back to me.  PNC tried numerous times to object to the automatic stay but the judge denied.  5 months while in Bankruptcy the trustee denied my brother because the bank stated he was not on the loan. 

I have opened a complaint against PNC to stop the banks form lying too the home owners.  In all the letters they state "We are Here to help you" they are NOT!  I have gotten sick by the stress and frustration i got with PNC. They do not care for the homeowners they are rip offs. 

This is why i took the initiative to sue them.  Maybe this way i can get what i have asked for: A Loan Modification.
