I have been an active member of PocketChangeGPT.com for several months and have earned upwards of $300.00. I have been trying to recruit a downline and have been singing the virtues of this site.

On July 3, 2008, I logged on to my site from the home of another member. This member has not been active on the site but for the day I recruited her. I went online at another home primarily to print out a tax for that the owner asked me to complete. My home computer is not compatible with my new computer. It did not occur to me that I was not allowed to do this. When I recruited this woman, we were also logged on with 2 different accounts when I was showing her how it works. Also, on other sites with this policy is it crystal clear and the owner continually reminds the members of this policy.

I logged off the site and then went back on it a while later or tried to but I was locked out. I contacted the site owner on aol from his other gpt site and he told me my account was shut down because i cheated. I tried to explain but he logged off aol while I was typing my response. I then opened a trouble ticked which, as of 7/72008 he has yet to open. I also sent him 2 emails with no response. I have no documentation regarding the policy of PocketChange because you need to log on to the site to get it.

I currently have over $200 dollars sitting in my PocketChange account. It seems completely unfair that I should lose it over a mistake. He can easily check to see that the member whose computer I accessed has not logged on nor earned any money in quite a while. I have been an active member. He has earned quite a bit from my membership. If he is so intolerant of my mistake he should at least answer my email. In addition, if I am labeled a cheater, why would he still let me have access to his other gpt site and his forums?

I am requesting that he transfer the balance of my account to my paypal account. I will be happy to send him the w-9 that he requested.

Update - Response to Rebuttal

Before I address Dan's rebuttal, I have to make one correction. I originally said the incident happened on 7/3/2008, I should have said 7/4/2008.

The owner's rebuttal did not address the situation at hand.

There are the facts.

1. I am aware that PocketChangeGPT pays its members. Having been one, I was paid several times. That was never the issue.

2. He also mentions another site he owns, GatorGoldOffers, and uses it as his defense. He neglected to mention that he closed down that site without notice, and only transferred funds into PocketChangeGPT for those who asked. Many people have lost money because he never made it clear that a member must ask to have his/her funds transferred or cashed out. This is a clear example of his questionable ethics.

3. He failed to mention that when I accident accessed the site over the July 4th weekend, I contacted him on AIM. He told me my account was deleted because I accessed my account from another member's home. No other reason was mentioned. He then logged off, literally ran away, as I was typing my response.

4. I then opened trouble tickets on yet another of his sites, PaidtheFastest. He never even opened the trouble tickets. I also emailed him on 7/6/2008 and 7/7/2008, and got no response. I also tried to reach him on AIM again.

5. While he quoted from my email, he failed to leave out that I agreed to forfeit any payment of offers completed on 7/4/2008.

6. He had plenty of opportunity to quote his terms of service, yet he chose to ignore me. When responding to this complaint he included a link to the terms of service for PocketChangeGPT.

This is the clause that deals with my situation:

Complete the same offers more than once on ANY site
Using Fake/False information
Logging into the site on any computer OTHER than your HOME computer
Having more than one account

By simply searching the cache on live and yahoo, I found proof that this clause was added after 7/4/2008 and at the time I logged on from another member's home, there was no site policy indication that doing so was grounds for having ones' account canceled.

There is nothing there addressing the issue of where one can log on to the site. Unfortunately, yahoo does not date its cache. However, this page gives a member count of 1152.

This link is from the Live.com. MSN does include the date the page was cached, 7/4/2008. This is the date of my situation. MSN did not cache the page that contained the terms of service, but it indicated that there were 1140 members. PocketChangeGPT has been growing rapidly. An addition of 12 more members suggests that Yahoo's cache was done a few days after MSN's.

Logic clearly tells us that the terms of service on 7/4/2008 DID NOT include the clause regarding only using one's home computer. Hence, the link to the terms of service in Dan's rebuttal is proof that he manipulated the site rules for his own gain.

I said from the beginning that I made a mistake. I tried to discuss it with him on numerous occasions with no response. While I made a mistake and came forward, he ignored me, tried to intimidate me and even falsified documentation. I read the terms of service prior to having someone whose home i visited frequently, I knew I didn't see anything there regarding members logging on. At the very least, my sanity is intact.

You were removed from the site because you clearly broke the terms and conditions. It DOES state that it is against logging in to the site from any other computer than your home computer.

"When actively using the site, you agree to all changes to this policy, and agree to maintain a fraud free environment. Examples of fraud, but not limted to are:

Complete the same offers more than once on ANY site
Using Fake/False information
Logging into the site on any computer OTHER than your HOME computer
Having more than one account

Should you break any of these rules, you will be immediately removed from the site without pay."

It is also against the rules to complete offers from another members house, which in your personal email to me, you admitted that you did, therefore again breaking the terms.

"I did log on to another member's account in error. This was unintensional, and as you can see, this member has not been active in PocketChange in quite a while. It didn't even register with me that she is a member. There was no intent to be dishonest on my part what so ever. In fact, I originally logged on because I needed to print out the w-9 for you requested. My hope printer is not compatible with vista and I could not do it at home. I tried to complete a few offers while waiting for the printer." - Your Email sent to me on July 6th 08 admitting you broke the terms.

And thirdly, you were also found to be duplicating offers on my sites GatorGoldOffers.com and PocketChangeGPT.com. This is also strcitly prohibited, and I have substancial proof that you did infact duplicate offers as I have record for every lead you ever generated.

You broke the Ts and Cs numerous times, and that is why you have been removed from the site without pay.

You Broke the Terms of Service

Logging into another members account on ANY gpt site is strictly not allowed.

You must have not read the Terms of Service, as it is clearly stated there, which you agreed to when signing up for the site.

You also failed to leave out a key detail in this post, which I have email proof of you telling me that you did complete offers from this other members house while there waiting. This again, is strictly against site policy.

"It didn't even register with me that she is a member. There was no intent to be dishonest on my part what so ever. In fact, I originally logged on because I needed to print out the w-9 for you requested. My hope printer is not compatible with vista and I could not do it at home. I tried to complete a few offers while waiting for the printer."

The above is a direct quote from you, where you admit that you broke the Terms of Service, as it clearly reads:

I did nothing wrong, as you broke more than one rule. I always pay deserving members that follow the rules, and I have plenty of proof to do show.

I also owned GatorGoldOffers.com, where I have more than enough proof to show that you duplicated offers on both sites under the usernames ampael and ampael100

I will be in talks with other site owners to see just how many offers you did infact fraud, as I know I have seen your name on DealBarbie.
