I purchased a home from Premier homes in Dallas Tx. In our new house they built custom cabinets in the kitchen. My wilfe and I opted for the appliance upgrade. We payed $750.00 to upgrade from standard appliance( microwave, dishwasher, stove& oven range) to stainless steel. We also included the custom stainless steel REFRIGERATOR, for this we payed and additional $1,600, yes I said 1,600 more. The sales person, Casey Moran, told us it would be the exact one that was in the model. We walked over to the refrigerator looked through it, it fit the custom cabinets perfectly. They were made for each other.

Casey wrote up the contract, in it he put stainless steel side-by-side refrigerator, and payed $1,600. I had asked him again if he was sure we would get the exact one that was in the model, will if fit in there the same way, and look just like that? He reply yes, thats the ONLY upgraded stainless steel we offer. We walked away happy. Days later we returned to check the progress of the house( the house was about 98% complete when we signed the contract) We were told they would be finished in about 4weeks.

The house not been touched, then a painter comes in and says HI and starts gathering his stuff. I asked if he was going to finish painting today so we would meet the deadline. He said when I get payed, I'll paint. Premier owes me $10,000 for painting their other houses. He went on to explain to me that other trades were having the same problem. They were not being payed for their work. The builder (Vance) shows up and the the two men have words. I told my wife lets get out of here before this gets ugly.

I drove straight over to the sales office (8 houses down) and ask Casey Moran, the sales person what was going on. I told him I wouldnt buy a house from a company that misuses people that way. Vance, the builder comes in (livid) and appologises for the (s****.> My wife and I then walked through the model again, Casey in tow, and we noted things that looked a little different than our house. ( we have the exact floor plan as the model) I pointed out the refrigerator again(2nd time) and he told me everything is fine they will have the refrigerator there next week. Great! Now being skeptical I check back every couple of days. I asked everytime I saw Casey or Vance about the refrigerator, they finally told me that it was in the contrat and they would make sure I was happy.

Weeks went by and nothing happened NO REFRIGERATOR , NO PAINTERS, When I asked about the refrigerator they said it was back ordered. They eventually finished the house 60 days later, remember it was 98% complete. They took so long that we lost our first lender and our interest rate.

We did our walk through (friday) and no Refrigerator- everything else was fine. They assured me that it was back ordered and would be delivered on tuesday. Ok, we closed.

Tuesday they delivered a stainless steel side-by-side refrigerator. It was 3 sizes to small. They have the same one for sell at Best buy for $800. I called Casey and he told me he was aware of it and that they would repalce it. I showed Vance and he pointed out to me that they damaged the handleds bringing it in and they would repalce them, then replace the refrigerator. I told my wife not to use it, I didnt want them to say it was "used". Vance, the builder, told us " you have small children go ahead and use it we will replace it. WE have not used it. We took pictures of both refrigerators to show the differance.

All involved, Sales people, builder, and us agreed it was WRONG. They said corporate had to make the final descission about replacing it,and they wouldnt have a problem it was in fact not what we bought. A week later we still have the same Refrigerator. Casey Moran,told me corporate said "tough, they had already closed". "We dont have to do anything, They shouldnt have closed without seeing the refrigerator."

I contacted TRCC- texas state building commission, they told me to write a letter to the company and gave them 10 days to respond. The man I addressed the letter to was named JUSTIN WEBB, owner premier homes. The vice president responded, they wrote back and said if I pay $1,000 more they will get me the right refrigerator. They said it was "USED" and they couldnt resell it, remember the builder told me to USE IT, BUT we HAVE NOT. I went and talked to the sales staff and had them come to my house and verified that we have not use it. (we have another one in the garage)

I tried several times to speak with "corporate" and they would not respond. I tried to be very professional throught the entire process, I wish I could say the same about them. I was promised over and over they would fix the problem and make sure we were happy. WE ARE NOT.
Its now been a month later and we still have messed up handles and wrong refrigerator. Premier homes and Casey Moran lied to me.

I agree with you and believe you are stating the truth. I wish I would of known about this earlier. They swindled me also. I also understand that it has happened to others in Little Elm, TX. Premier Homes has recently been red tagged in McKinney, TX for not paying fines and fees. The family owners are hiding behind one business and have the following Altura Homes, 5Star Homes, Premier Homes and Webb Family Builders Homes. They fail to tell buyers that they are going to deposit the money in their account and not an escrow account.

They may even have multiple contracts on one lot. Buyers usually get very tired of waiting for a home to be built, so they cancel the contract, but lose their earnest money. Meanwhile, their making a lot of money on keeping earnest money, not paying their vendors and hiring cheap labor who are not always professionally skilled.

Call the Collin County District Attorney's office. A few calls and complaints will secure a prompt criminal investigation. You can find the online complaint form in the City of McKinney website. Simply, search for the Collin County DA's office, or their office.

Also reporting them the State of Texas Contractor's Licensing Board is a great place to start. Many loans go through HUD, they do not like losing money: Report it to HUD. Try your local senator's and/or congress office also.
