Well, they did it. They got my bank (I have no idea how they obtained even the name of my bank) to put a hold on my account for DOUBLE the amount they say I owe them. I do not know this debt. I have not contacted them, as after reading here that would only result in futility. I am wondering what steps I should take in order to get this "hold" taken off my account. The debt is under $1000 but my bank sent me a letter saying they were served with an information subpoena with restraining notice. Not only did my bank put a hold for double the amount, they charged me $100 fee for processing Palisades' paperwork!

How should I respond? I know I should in writing, and demand proof of the actual debt, but they apparently already obtained a default judgement against me since they went in and put a hold on my bank funds.

Any suggestions for lawyers in the NYC area? I don't have a lot of money and what little I have I don't want to spend on lawyers to fight this. Can anyone help?

Lisa,

Go to your bank in person and speak only with a manager. DEMAND copies of all paperwork they have that affected your account. Make them certify them as true and correct copies with a notary seal before you leave.

Now go to the courthouse in the county in which you reside, and get a copy of any lawsuit filed.

This is where you beat them. It is almost guaranteed that they falsified documents to get a judgement, and if this is the case you can get a stay of judgement and also can file criminal charges for larceny.

They probably "served" you at one of your old addresses or employers. This is the oldest trick in the book. Palisades and Pressler&Pressler are the lowest form of lowlife in the book. Be sure to file Bar association complaints and ftc complaints today. Also go to budhibbs.com and click on the NACA link and consult a lawyer who specializes in these matters.

You WILL need a lawyer to file the stay. however, you can countersue to pay him/her, and to recover other damages like fees, time from work, etc..
