In August of 2006 I signed a contract with Pro Gas and Heating to have my boiler replaced as the technician indicated that I had a rusty heat exchanger. I made a deposit of half of the installation price. For a variety of reasons, I decided to cancel the contract 9 days later. I waited for 6 weeks to get my refund back, and when I finally contacted the company and spoke with the owner, I was informed that I would get my deposit back, less $410 for 3 hours labour and an administration fee. I had to wait until October 31 before I got my deposit less "charges" back.
After contacting Better Business Bureau and the Business Practice and Consumer Protection Agency, I ultimately took the company to small claims court. Space does not allow me to expand on all that this involved, and the variety of things the owner did to prolong this process. This proved to be a long and emotionally draining experience, but ultimately the truth prevailed. I only wish that I had searched this company on the Better Business Bureau website before doing any business with them.

Better Business burea has now given each company a letter grade ranking based on the complaints they have received and the way in which they have been dealt with by the company involved. Pro Gas & Heating received the lowest ranking possible - F

And still he continues you have received your monies James and made your complaint online which played no role in you receiving your settlement. yet you continued your diatribe of which only speaks to your compulsive obsessive personality such as you have already received your compensation and in true form; that is not enough for you and is indicative of your disposition where as it's never enough and you want more Which very probably explains why, you find it jointly acceptable, that this company and it employees work on your behalf for free! And then after settlement you promote a smear campaign against same. Shame on you! Move on!

A few things to consider when reading the rebuttal by the owner:
1. I presented evidence under oath in court (which the owner had the opportunity to peruse) which was a copy of an e-mail sent on th 9th day cancelling my contract. I had tried unsuccessfully twice to fax my cancellation to the office but both times I tried, the fax machine wasn't working. To suggest that I perjured myself in court is not a charge that I take lightly. The fax which the owner claims I sent on the 11th day was never presented in court, and I have never seen a copy of it.
2. To suggest that I was pursuing this matter in court because it wasn't costing me anything is a gross misrepresentaion of what I said in court.
3. The owner was given ample time by the court settle this matter. Why he chose not to adhere to the terms of the original payment schedule is hard to understand.
I have nothing to gain at this point in this matter. The matter was settled in court - my recollection of what happened is completely different than the owner's. I hold no grudge against him - I only wish that this matter could have been resolved without having to take this course of action.

This customer did not cancel his contract 9 days later as he claims (of which falls within the consumer protection act a guideline for legally canceling an order), he cancelled his contract on the 11th day via fax and when asked to produce proof of his cancellation date line, claims he could not, sighting computer problems. This man is a liar! This company brought this mans boiler for his installation after receiving his deposit and upon a signed contract. This customer fully expected to receive a 100% return of his deposit after this company had gone to the time, trouble and expense or pre-fielding the job, running around to the suppliers, all of which costs money and was on his behalf, only to have him cancel 11 days later proclaiming he shouldn't have to pay for our efforts. If you wanted free sir go to welfare!
This customer was reimbursed his deposit minus our expenses and fees as per contract and shop time spent of which was only fair. This guy clearly thinks we are free and he can wonder in and out of agreements as he pleases without being accountable for the costs others incur for his decisions and requests he enters into. This customer sued this company in small claims sighting that he had "all the time in the world" to recover his $410.00 (bringing his deposit to 100% refunded) because "he was a teacher and was being paid for his time off to come to court" and this was a no loss financial situation for him. The judge was not impressed and neither was I, having to waist my valuable time and valuable court time in aid of this cheapo getting free work from this company, it's workers and money out of my pocket. I wonder if he would work for free? Or spent money on some stranger with a smile as he was asking me to do, I think not! The judge refused to hear the case at trial and angrily sided with my opinion that this man was indeed a mooch. I offered $200.00 to make him go away and the judge push this mooch into reluctantly accepting. We ended up back in court a short time later because I fell ill with the flu and didn't pay this mooch his money fast enough. This mooch quickly seized upon the opportunity and I ended up paying a tad more. This customer has now filled a negative report here on this sight how tawdry
I would suggest that your settlement in court sir was not an endorsement that you were right in asking this company to work for you for free as you have, but more so the cost of business in satisfying an individual that is unfamiliar with the words accountability, responsibility and fair compensation for services rendered.

It is not surprising to see new complaints about Pro Gas and Heating being registered on this website. I strongly suggest that anyone who has had unfortunate dealings with this company contact the Business Practice and Consumer Protection Agency. In my dealings with Mr. Lowe, he referred to the Consumer Protection Act as a "draconian piece if law". He is verbally abusive, and always has a ready list of excuses for delays or lack of punctuality on his part. If you have a valid claim to pursue in small claims court, I strongly urge you to take this course of action.
