This all began about 4-5 years ago. I had a Providian credit card and I could not make my payments due to money probs.

Bal was about $2800. After several months I joined
a debt management program and had no problems with any creditor agreeing to payments except with Providian. They said my account been too long past due. Eventually they apparantly sold my account to Portfolio Recovery. They are a joke. I made arrangements to start payments of 100 a month with the interest stopped(the balance was up to $5300!!) I paid for about a year and had to ask to skip a month and they said ok.

Then in June, I was really struggling and called again to see if I could skip a month. Wow, you would have thought someone died. They would not let me unless I made a double pmt the next month which was impossible. I argued with the "supervisor" who did everything to make me feel worthless. The would garnish my wages, liens on my house etc. I told her I was behind on my utlities and house pmt and with 4 kids those were priority. She told me that THIS account was a priority. Im sorry but my kids eating comes first.

Needless to say, I said a few words and hung up. I called back 10 mins later and asked if i could make a partial pmt and she said no, I was already turned into "legal". Letter from legal came next with the same results- they would settle for less but what good does that do when I was having trouble with $100!! Again made me feel worthless! Next comes the letter from Javitch, Block and Rathbone!!

I called and left voice message. No retun call so I tried again today. Wow, am I a piece of s**t. If "he" was needing money he'd go to family or frinds etc etc etc. He had every trick in the book. He wanted $600 down and pmts!! I have never once said I wouldnt pay this but I can not pay more than the $100 amonth. It's the best I can do right Now. We have no health ins and a lot medications and medical we cant do without. I'm trying but it seems like the creditors won't try back.

DO I still send payments- will they really take me to court. I'm lost as to what to do!

...is don't send these people another cent. Send them a cease communication letter via registered mail, return receipt, demanding they stop calling and communicate only by mail. Then, when the letters come throw them in the trash and forget about these bums.
Here's what's going on: When you got three months behind on your Providian bill they wrote the debt off and sold it to a collection agency for pennies on the dollar. The money you are paying isn't going to Providian, it's going to a company that buys debt like this and makes money by hounding people like you who are down on their luck. Your credit is already ruined; the quickest way to get straightened out is to forget about this and let it drop off your credit report in seven years.
Don't accept any offer to settle for less; if you sent them $1000 to settle, they would sell the remaining debt to another company which would then begin hounding you. Every time you sent them a dollar it restarts the seven-year clock.
If this has been going on four 4 or 5 years, chances are they would have already sued you if that's what they wanted.

Please go to google & type in Creditboards...this site will show you how to get a debt validated, send cease & desist letters and give you valuable consumer info. It is a free site, and will greatly help you advice wise....You need to stop talking to them on the phone, create a papertrail instead. Angela, this is not a hopeless situation!
