I have been living in my home for 9 years. My husband and I both lost our jobs and we were unemployed for 3 years. Our home has a 1st mortgage with CitiMortgage. We were able to obtain a loan modification from Citi. But, since we had very little income, we got a check in the mail from Bank of America for $50,000. We never asked for the money, but it sure came in handy. It became a 2nd mortgage on our property. Unfortunately, it didn't help us enough, so we filed for a Chapter 7 Bankruptcy which was discharged in February of 2011. The BofA 2nd mortgage was included in the BK. Our attorney told us that BofA could not come back to us for the money anymore. Everything was fine until March 5, 2013, when I received a Notice of Default and Election to Sell Under Deed of Trust from Quality Loan Service Corp. I called them to explain the circumstances of the BK and what our attorney told us. Quality Loan Service Corp told me that my house was in foreclosure with BofA and unless I paid $8277.50 immediately, I would have 90 days until the sell date. I called BofA and spoke with their BK department as well as their foreclosure department, and was assigned a Customer Service Manager to investigate this claim. I spoke with my CS Manager today and was informed that BofA was not foreclosing on my home and that since none of the documents had a BofA logo on them, that BofA determined it was a case of fraud. I was also informed that our CitiMortgage 1st mortgage of $475,000 would have to be paid off by BofA before anyone could sell my home. BofA stated that it would not benefit them in any way to pay $475,000 to get their $50,000. BofA has no intention of trying to get the money. When I googled Quality Loan Service Corp today, I found this ripoff report site and after reading other homeowners problems with QLSC, I want to make sure that everyone knows about this company. I hope they don't try to illegally put my home up for auction, or try to do anything else with my property.
