We moved from Texas, to NM in July 2018/ We signed a  month to month lease on a house in Maxwell, NM from Cindy McGinnis Quest Realty.  We immediately realized the house was not in good condition but we could live there while we hunted for a home to purchase.  

Although it was a month to month we were assured the house was not in condition to sell although there was a for sale sign on the front of the property with Quest contact info.  We explained to Cindy that the house was cute and we could live there confortably while we searched for a better property.

We would of course give proper notice etc.  But, the floors were uneven and the bathroom slopped away from the rest of the house and one would have to hold on to the walls while walking to the restroom or the slant might prepel you into the bath tub.  The kitchen had cabinets so high off the ground that at 5'2" I was unable to use most of them and we had to install removeable shelfs in the laundry room to make up for the lost space.

The list can go on and on.  But, hey it's a rental and we were just going to be there a few months while we found something to buy.

That's enough about the conditions which were not the real problem.  The problem is Cindy McGinnis the realtor.

We liked Maxwell where the house was located.  The Village only housed a few hundred souls.  We were starting to meet neighbors and make friends.

When we started hearing the rumors about this house and the realtor.

The villiage referred to our rental property as the Guest house.  It turns out that the realtor has been renting this house out for years and then a few months into the lease she calls up and kicks people out.  Well we did not think much of it. who knows why those people were asked to leave?  Rent issues arguing with the realto who knows?  Then when I went to th eelectric company to finish the sign up paper work and was told that they could not give us an everage monthly cost on the house because no one ever stayed in the house long enough to collect averages.  We were told most rentsrs leave within 4 months.

That seemed odd.  I went to city hall to pay deposits on the water/gas services while speaking with the lady working at City Hall, she had moved there for her current job.  When she got the job there were no properties available for rent except our house (the guest house).  SHe told me winter when she lived in it was tuff.  The bedrooms had no heating vents.  She asked me if the realtor had ever fixed the back door?  I told her I was not sure.  It seemed to be working just fine.  I could tell she had more to say but I did not wish to get into a he said she said thing that involved the agent I have to work with.  So, I did not press her.  After a few months the realtor called me around dinner time and informed me that the owner wanted her house back and we needed to get out.

About that time we attended a Village of Maxwell meeting and the new people we met told us more about the history how that house is a community joke.

Cindy the realtor kicks people out every few months and yes the house is not fit to purchase has lots of structure damage.  Then we find out that Cindy had called the lady from City Hall, at about 11pm one night and told her she had to move.  The owner wanted the house back.  Beginning to see a pattern, we decided to see what could be done.  The whole time running crazy looking for a place to purchase and get usour or rent and get us out asap.

When we could not find anything and realized we needed more time to put a move together to another state we had exhausted all possibilities in NM.

We decided to research the rules and regs of evictions.  We discovered that it was illigel for a realtor or owner to evict someone without formal written notice.  The law pacidcally notes phone calls, and emails are not accepte as eviction notices.  Cindy had been and probably still is breaking the law.  By calling us only.

Also the notice has to be in wrting and the 30 days start the date the rented signs for the notice.  No notice ever came.  So, if we had followed her instructions without question.  She would be able to keep our deposit for non payment and it would have bene our workd against hers if we recieve a call at all.

So, we did the only thing we could think of to give us the time needed to move and protect our deposit.  We sent her formal notice of evacuating the place 30 days from our last normal rental due date theth of each month and we sent a final rent payment to her.  Which was cashed then a few days later Cindy calls up and wants us out earlier.   We explained she had forced us to study the NM laws and we would leave the house in the best condition we could making sure it looked the same or better than when we got it.  But, that the law was the law and we would leave the end of the month like the check letter said.

The only time we spoke to Louie McGinnis, he called up screaming at my husband and threatening us.  We assured him we had studied NM law and would live out the month as stated.

I can only speculate on the reasons for every four month evictions.  If people are paying rent on time and not bothering you with complaints.  WHY would they want to evict??  The realtor gets money every time she rents a place.  She gets lots of deposits if she made it look like people did not pay their rent like we feared.  

Well we have been out of the house and NM for two months now and we are still waiting for our deposit refund.  Their contract states we should have been given the money back 30 days after departure.  I have to assume I can kiss that money good bye.

They tried to put us in a spot were we could not afford to leave and no matter what house we attempted to purchase they would tell me it already had 2 contracts on it and even though we were willing to pay asking price and all closing costs she rejected our offer.  

From what we have been told by other realtors it's the deposits it's the commissions for re renting and not putting any money into repairs just letting renter after renter move in and out damages the home with wear.  Devaluing the property until the owners get tired of it and just let the realtors purcahse it themselves.  They own a large percentage of Raton and surrounding areags. most of them are slums that they go in and dress up cosmetically.  They do not sell from what I can tell they want to own all of Raton.

The houses they refused to let us purcahse are all still on the market.  They were trying to force us to purchase the one we were in rather than have to move again.

ANYONE WANTING TO GO TO RATON BEWARE.  There are two realtors running the same scams.  Neglect is everywhere.  Houses many are adobe and if the original owners needed a new room they would add it themselves.  No inspections. every room of many homes we view were uneven this one one step up that one one step down.  

There is a reason only rich people can live there because if you want to move to New Mexico you need to be prepared to find property and build the house yourself.  The trash they have on the market is not worth the trip.

There are a few agents in those areas of Raton NM or Trinidad Co.  but you need to be very careful they are far and few.
