I called in sick three days in a row, but was still made to come in to work. I was finally able to talk to Debbie, the store manager on the third day. When I did, she was very argumentative. The conversation ended with her telling me, "Fine then! Go Home!." Then she abrubptly hung up the phone.

My co-worker, Echo, was eating dinner with her husband (on the house). I proceeded to tell her that Debbie gave me permission to go home. My roomate, Mary, witnessed the phone call to my manager and the conversation with my co-worker.

Echo, my co-worker, asked me if a replacement was coming and I told her that Deb said she was coming, but told me to go home. I then made sure that it was ok that Echo and her husband were there. Echo said, "If she said go home, then I guess, go home!"

I replied, "Is that ok?"
Echo replied, "Yes."

I had given my two weeks notice of quit approximately 9 days prior to this incident. The next shift I came to, I was told by Deb that they did not need me. I said, "Oh, my two weeks are up then?" Deb said, "No, you're fired. You walked out."

I said, "No, I didn't. I came in for my shift and then was told to go home, by you." She then proceeded to tell me that I broke protocol. When I got my check, instead of receiving my regular wage of $6.50 per hour, I received $5.15(minimum wage). I tried to fight it with Lynn Carter, the owner of Quiznos.

He said,"Go for it, call the Better Business Bureau! I've had a thousand employees like you. I know the law!"

Also, Deb and her daughter, Kelly, would have me do "man jobs" and would stand around joking about it while I was completing the jobs. My roomate, Mary, and other employess witnessed this.

Without cause?? I don't think so. The boss let her go home sick. I think she is just pissed and is trying to screw you.

Mary, I don't know what your state labor laws say about this, but the first call I would make tomorrow is to your state Labor Board. File a complaint against the company and specifically your boss. Be prepared for a fight becuase it sounds like your boss is more than willing to lie to the labor board.

Second step I would take is to apply for unemployment. I don't know you are elegible, but the only one it would hurt is your former boss.

third step: file a small claims case against your former boss for the difference in salary. If you can, file against her franchise too. Of course you need to ask for court costs too.. You might not win, but you will have fun trying..

Mary, your story doesn't make much sense. In the first paragraph, you mention that you called in sick, but were made to go in to work. Apparently "Echo" was your point of contact for the first two days. On the third day, you called in and 'Debbie' took the call. Your conversation turned somewhat ugly, then she made statements which equated to your leaving without her whole 100% approval: she figured that your services would be worthless, at best, if you stayed. Couple to this, you were 9 days deep into a 2-week notice of leaving their employ. Tack on the 3 days that you were 'sick', short of the 2 days at the end of the 14 that you would have been off anyway, and presto, you hit the 2 weeks! I assume that Debbie is a regional manager and that Echo is the 'floor' manager. Otherwise, beings you were made to come in, why would you call work -- from work? What makes this seem strange is that, apparently Echo, learning of your illness, advised you to call Debbie. It's irrelevant whether or not Echo was eating on the house or not.

The fact is, after the call to Debbie & she gave you 'approval', the conversation should have ended there. The fact that you made comments to Echo 'is that OK?' raises red flags all over the place.

When a person is truly and genuinely sick, they are going to make as few calls as necessary & go home. Your situation is not unique, it's just over-indulged upon. The fact that they dropped your salary rate to minimum wage isn't illegal.

They felt that everyday average 'Joe Smith' shows up on time and is productive. Why should he get minimum wage while you're out on 'Slick Leave' and earning 6.50/hour at the same time. Believe me, you can bet Lynn Carter has all his ducks in order and has had to fight pettiness before. In short, take your lumps and move on.
