Hi, my name is Jacques Barnard and I am from Pretoria in South Africa. I was "sold" a dream holiday over the phone sponsored by Imperial Majesty Cruises, Ramada Plaza Resorts and others; similar to all the other complainants on this site. It sounded good over the phone but they did not offer any time for thought and planning.

My wife and I are expecting our first child during Jan 2006 and after reviewing our situation, decided that we would not be able to use the holiday; finances w.r.t. the exchange rate is also prohibitive. I therefore need to cancel it and obtain a refund but after reading the various accounts of how people have struggled with a similar issue, I am concerned that I have become yet another rip-off victim. Being in South Africa makes it difficult due to distance and exchange rates and therefore I request advice from anybody who may be able to point me in the right direction. Does the Florida State law allow me to cancel within 30 days and does this apply to my case too?

Although the salesman mentioned that I would be able to sell/transfer the tickets, I was not informed that cancellations and refunds were not done. How do I proceed? Do I need to contact the American Embassy here in SA for help?

I am happy to report that Ramada actually kept their word and refunded me the full amount; the funds came through on 26 May, according to the timeframe they gave me. However, due to exchange rate differences, I lost a miniscule amount.

Maybe they have learnd their lesson or maybe you just have to be firm in standing your ground?

Advice related to the latter is what I relied on -

Ramada - Episode 2 they would assist me in recovering my funds

I contacted Ramada's customer services after consulting with my bank who confirmed that they would assist me in recovering my funds should normal procedures not suffice.

Hats off to Ramada on their displayed professionalism during my engagement with their customer care preople; the agents were very polite and although their customer care specialist tried to talk me out of cancelling, he graciously conceded defeat. However, he only wanted to refund about two thirds of the funds but after me citing that Florida, South African and International law required that I receive a total refund, I was placed on hold for a few minutes, obviously while he consulted someone more senior.

The outcome: they have agreed to cancel my holiday with a total refund within 7-10 days. I informed them that should this not be done, my Bank would certainly recover the funds; they were very defensive in this regard, though! The entire process took only 10 minutes, which really surprised me as I was prepared for a longer battle. Have they perhaps accepted the fact that there will be cancellations and have perhaps learnt from history?

Well, now it is wait and see....I'll keep you updated.

Thanks for the advice received. Maybe you all should visit South Africa some time (through a reputable tour operator, that is) - we have great wildlife parks, resorts and a great coastline!!

Try it follow the same steps I posted on May 10th for getting a refund.

Hi Jacques,
My suggestion to you is to try and follow the same steps I posted on May 10th for getting a refund. I believe that the Florida State Act applies to companies in Florida and that it does not matter from where the customers hail. In any case, it couldn't hurt to try if it has not yet been 30 days since your purchase. Good luck to you and please keep me updated as to your progress. If you can not get your money back this way, there must be other steps you can take!
