After seeing a video of Dr. Oz extolling the miracle weight loss supplement Raspberry Ketone in an online add, I decided to try the trial offer of a 30 day supply of both the Raspberry Ketone and the ColoCleanse Pro recommended by Dr Oz's 'expert' to accompany the Ketone for the most benefit.  The cost was $4.95 each for shipping and handling.  I'm very careful of online orders and watch closely for 'repeat charges' or 'will be billed unless cancelled by....' etc. tricky little boxes to be checked or unchecked which might lead to unintended charges.  Should I ever go forward with the purchase, I flag my calendar as a reminder of the cancel date!  I saw NO such issue and believed I was only to be charged for the trial bottles, 4.95 for each product.  If after the trial use I wanted to purchase I could contact the company.

I took the products as recommended and received no weight loss benefit.  I expected that to be the end of the experiment.  Yesterday I looked at my checking account and was shocked to see two charges for $89.99, a total of $179.98!!!  I called the number on the bottle and also a contact number the bank had on file from the original trial offer charge.  After literally hours on hold for one number and the other number having a busy signal for 10 trys, I tried again today,  after waiting on hold a long time a representative answered.  She assured me I had created an ongoing account for the product and that I had had 14 days to cancel and since I had failed to do it in the time allowed the charge was non refundable.  I had to INSIST to cancel an account I had never knowingly created over her attempts to offer me a 'special' discount rates for my future use!  And if I would just keep using I'd acheive my goals.  i ASKED IF THE COMPANY DID NOT HAVE ANY POLICY FOR A REFUND if the customer returned unopened product and was unhappy.  NO! I feel like I've been robbed!

Reading the Terms & Conditions is very helpful

AUTHOR: term reader - ()

POSTED: Friday, March 29, 2013

If you just take time to read the terms & conditions, which there is usually a link at the bottom of most of the "trial offer" companies. This companies terms read:

Upon signing up for your trial offer, the credit card you provide will be charged a One-time shipping fee which includes shipping insurance of $4.95 and you will be shipped a 30 day supply of Raspberry Ketone Breeze.

If you contact customer service to terminate your trial enrollment within 15 day of the date that you enroll in the Program, you will not receive any additional product and you will not be charged anything else. Your enrollment date is the date that you submit your order for the trial product. All orders are shipped within two business days and will generally take 5 business days to arrive at your location.

(Now this is the important part)
If you do not cancel within 15 day of the date that you enroll in the Program, we will charge the same card you provided at enrollment for the retail price of the product you initially recieved of $89.99.

(Oh look-this is part about the auto shipment)
Then beginning about 35 days after enrollment in membership program (and every 30 days thereafter) we will send you a fresh monthly shipment of the product and charge your card $89.99 when each supply ships. You can cancel monthly shipments and avoid further Monthly Charges at any time by contacting customer service Monday to Friday 24 hours a day and Saturday and Sunday 8am-6pm CST at 1-800-785-6012.

Try This To Resolve This Problem

AUTHOR: OleFred - (United States of America)

POSTED: Thursday, December 13, 2012

Just reading through your experience and may be able to help.  I took a look at the website you provided, and on the bottom of the page is a link to their terms and conditions.  Regarding their refund policy, it states:

Refund Policy
1. We refund all cases of fraud and unauthorized transactions included shipping and handling charges. Additional refunds are issued at the discretion of the company.

2. Customers are restricted to receiving a single refund per product ordered. Repetitive refunds are not permitted unless the product, as delivered to you, is defective. We reserve the right to refuse a refund to any customer who repeatedly requests refunds or who, in our judgment, requests refunds in bad faith.

Looking at this, it seems that they are obligated to refund your money, as the transactions were not authorized.

Step 1 is going to be asking them for the refund, and make sure your reference their policy above.  If they agree, they have up to 15 days to refund.  Never mind what their policy states about up to 30 days depending on your bank.  That's a load of ... well, you get the idea.  When a merchant issues a refund, it goes from them, to visa/mastercard, then to the bank.  The maximum time they're allowed is 15 days, and it's not dependent on your bank, but on the merchant.

If they agree to issue you the refund, allow them the 15 days.  After that, contact your bank to file a dispute.  The bank will NOT be able to dispute it until the 15 days have elapsed and there is no refund.

If they refuse to issue the refund, contact your bank and file the claim that day.  No need to wait if they're not issuing a credit to you.  You may have to close your card and order a new one to prevent any further transactions,  but the bank will be able to get this money back to you.

One other note, you will need to return whatever merchandise you have to them before disputing it with the bank.  They can't dispute it if you still have the merchandise.  Also, make sure you get confirmation of mailing and proof of delivery.  The postal service can add this to your package for about a dollar or two.  Keep your receipt and proof of mailing/delivery, the bank will ask you for it to help them get the money back from this company.

Finally, not only to the OP but to any one else reading this:  Be very weary of companies that offer a trial offer of their product.  100 percent of the time you will be enrolled in a recurring billing cycle at an astronomical rate.  These companies are typically very devious in their practices and will bury this fact in obscure places in order to get you signed up.  Once that's done, it can be a very long and aggravating process to get your money back and get the recurring charges stopped.

If, after reading all of this, you still want to participate in these trial offers (and they never work, by the way - the products are all junk) please consider getting a prepaid visa from your local drugstore and use that rather than the card linked to your checking account.  This can avoid so many headaches, fees, etc.

OP, hope you get this worked out, and hope you get your money back in a timely manner.
