R.D. Cessna and Associates, LLC Richard Cessna,Thom Williams, Karl Kirshner Did not settle SBA Offer in Compromise contract, Did not settle or work on business credit card debt contract Ramona California

Hired RD Cessna and Associates, LLC (Karl Kirschner and Tom Williams) to perform on 2 separate contracts to help us close our franchise/business.  Paid in full 10K to have RD Cessna settle our SBA/Bank loan for an Offer in Compromise.  Richard promised he could get our collateral back on the SBA loan and settle for approximately 60% of the debt owed with the SBA.  Richard will tell you these things move slow so that you keep paying them monthly and before you figure out they really aren't doing any work on your behalf. We found out after the SBA/Bank sued us for our collateral on the loan that their executive had told RD Cessna 2 months into representing us that they would not settle and were going to sell our collateral/assets to cover our debt to the SBA.  This was never disclosed to us and ended up costing us considerable additional legal fees, late fees and settlement costs in addition to the 10K we already had sunk into RD Cessna and Associates.  Our 2 inch binder which Richard will claim he has on our case is only our attempt at trying to email them for updates and next steps with no resolution as they don't answer their phone most days.  We have other franchiser's who also used this firm near the same time as us  with the same outcome, no negotied OIC.

We also signed a 3K contract with RD Cessna and Associates, LLC to have them settle our business credit card debt.  We were advised to stop paying on our business credit card debt by RD Cessna and Associates LLC.  Thom Williams promised that as part of our contract he could settle our credit card debt for 20 to 30 cents on the dollar.  Our business has been closed over a year and we are getting legal notices for debt settlement from these credit cards.  We provided all statements to RD Cessna and Associates and let them know we were ready to settle these debts. Some of these credit cards debts have changed hands from collectors several times.  Each time we have sent these legal notices to Thom Williams and asked him to negotiate a settlement.  Our creditors were not notifed in writing of representation from RD Cessna LLC and Associates except the first time right after we signed the contract with RD Cessna and were starting our 3K of payments Currently, Thom has stopped responding to our emails, his voicemail is full and we've had to engage a real Law firm to represent and settle with these credit card debtors.  Thom did not notify the collector's in writing that he was representing us or ever came back to us with a settlement figure like he promised of 20 to 30 cents on the dollar.  Same strategy here....move slow...collect your money and then don't perform on their contract.
