Remington Apartments Harassment of senior citizen tenants and violation of civil rights Ladera Ranch California

My Parents Recently moved in to a senior living community were there are several signs including in front of the managers office that stated that smoking is  allow on the property. Now my father does smoke and when I come to visit them I smoke too on the patio. Now my parents have a lot going on for them right now; My mother was recently diagnosed with bone cancer and has have to spend her time split between living there and spending several weeks at a time in treatment at City of Hope.

I'd been spending amajority of my time over there at remington helping my dad with things and keep things in order.I come over one night and find out that one of the women that lives in one of the apartments on the second floor came down stairs and proceeded to stand on the sidewalk in front of my parents patio and yell and scream at his about smoing. He tried to rationally with her (my dad is a really nice, sweet guy who hates conflict). However, she wasn't interested in talking or trying to resolve or work something out with him. She just yell and screamed at him irrationally and then stormed off.

Now, I was understandably very upset and applauded by all this and had planned to speak with the property management about this, but he didn't want anymore conflict so I let it go.  However, a couple of weeks later a written notices slid underneath their door. It was from the property managers office. The letter was written in very vague legal jargon edvising them that by smoking they were violating a covenant (the covenant being cited by the way was  one that actually has to do with noise poplution) which they had falsely tried to claim was somehow about smoking threaten them that if they didn't comply and quit smoking their lease would be revoked and they would be forceably removed (forceably) by the orange county sheriff dept. and then have to pay a $600+ fine for the whole thing.

Now, this was rather up upsetting to my father as he didn't the law thought perhap thia was something that they could do. I however was awareness that this was completely illegal and the fact that they would try to threat and harrass any elderly citizen and use scare tactics to maniplate and take advantage of them was shameful and cruel.

Whenver my father would go try to speak to them, they would talk over him, interupt him and strong-arm him to get him to comply. I when to the property management office after the 3rd harrassment to try to work this out. I handed them a signed letter which statement that I would be handling this matte on behalf of my father and that he had given me full proxy-power and authority.

They said tha they refused to discuss the issue with me and when I asked them legally for a copy of the agreement with the supposed convent he was harrass and threaten with eviction for having violating, the yrefused to get it to me and they said that this was between Them and Their Resident not Me.

After I pressing the issue the property manager say and I quote "This is Not a Smoking community" and when I pointed to the sign in front of the management office which says "This community Allows Smoking" the response that wis given to me was "This is Not a Non-smoking community."

After trying to reason with them, I was  informed that their policy is that if anyone smells the smoke or even has to close their windows at Anytime to avoid smelling it temporarily  that that is harrassment and a voilation for that persons civil rights. The property management has also made no efforts to create anyplace for them to smoke at on the property whatsoever.

Now of course, in order to get my parent to sign the lease for the apartment so that they could fill the empty space, they were very friendly and told them that smoking here was completely fine. Now they are threatening to revoke their lease, keep their money, have the police forceably remove them and throw them out into the street and make them pay additional fines for any damages by made by the police in the process.

As anyone who is reading this can probably understand I am enraged at the abuse and disgusting treatment of any senior citizen in this community, let alone the fact its my parent being threaten. Even now as I am sitting outside written this report there have been a small group of people in the clubhouse ranting and rave and saying a lot of very nasty things about my sitting out here smoking. They haven't even bothered to close the clubhouse doors while they do it and yet not a single person has come to say anything to me and I am still willing to be reasonable and comprise and work with them to reach a workable agreement. 

I will be honest and admit that I would love to start ranting and raving and fill this complaint with all kinds of spiteful and hateful things about every single person in that little hate group especially the  property management staff. My father and I have enough to deal with taking care of my mother. But I now that that is not what my mother would want me to do that. So instead I have decided to calmly and rationally just explain the facts for this situation. So that at the very least, this won't happen to anyone else again. I know that this
