On Oct. 11, 2009  I was sitting in my house when my roommate informed me that there was a tow truck near my motorcycle in front of our apartment. I ran out to find a tow truck (City of Portland # 2132) from Retriever Towing in the act of moving my motorcycle onto the rack. It had been parked on the concrete slab of my own garage. When I approach the tow truck operator, I observed that my vehicle was not yet secured to the truck and that it was still on the ground. I informed the tow truck operator that the vehicle was mine and that he had to release it since it was not yet secured, so he was not in possession of it (PCC 7.24.016 G). This is the first violation of city code under which I should not have had to pay the $100 drop-fee (or a Release at the Scene fee defined in PCC) demanded by the operator. The operator was holding the motorcycle upright with his hand and threatened to drop it on the ground and severely damage it, if I didn't pay (Violation of PCC 7.24.016 A: taking care). After an argument, he removed the motorcycle from the property without properly securing it; I followed him around the corner to SE Francis and 39th Ave where I could see him securing the motorcycle (Violated PCC 7.24.017 D by removing the vehicle without securing it). I finally paid the $100 fee demanded by the operator to my Visa card (see receipt).

First being able to quote code while your motorcycle is being "towed" is pretty impressive.  Can we guess that you have had this problem before?


Second if you are saying that the Motorcycle was IN your garage as you are saying and they even attempted to take it.  I don't know why you didn't call 9-1-1 for THEFT, instead of just quoting "code".  Not only that but you paid them this money. 


Just seems like there are a few things missing here.
