Rick Cleveland the pool guy! Inc., a state licensed pool contractor was hired 01/08/16 and was paid $43,321 in total to construct a spa and fountain with equipment during the construction of a new home the homeowner was building. The spa is structural and located on the top floor of the home. The contractor did not finish the work and would not respond to the homeowner's contact attempts. The contractor abandoned the job before obtaining a pool certificate of completion from the City of Marco Island. Due to contractor’s abandonment, the homeowner had to arrange for the inspections and pay failed inspection fees due from the contractor in order to obtain a certificate of completion from the City of Marco Island.

The spa had a continual leak since the spa was first filled which the contractor is aware of. The spa is a structural component of the second floor concrete structure. After another attempt to have the contractor repair the leak, the contractor offered to have a leak detection company come out at his expense. The leak detection company was never contacted by the contractor. The leak detection was thereafter scheduled by the homeowner and concluded with a written report stating that the spa pebble finish was defective causing the leak along with other defective findings. The contractor refused to pay for the leak detection service which the homeowner then paid. Subsequently another leak occurred from the sheer decent waterfall requiring demolition of the tiled wall and replacement of the waterfall which the homeowner paid.

On May 18, 2017 the contractor signed for a certified letter from the homeowner providing a final opportunity to repair the leak. No response was ever received by the contractor. The homeowner then contacted a reputable pool contracting company to perform the repairs which required chipping of the old spa pebble finish, applying proper water proofing and a complete new pebble spa finish. Costs paid by the homeowner exceeded $10,000 with paid receipts available.

Homeowner has written documentation from two professional pool contractors as to the defective construction of the spa. A law suit has been filed in Collier County and is pending.

In addition to the poor quality of work, the work schedule was spotty at best. He would send someone at the end of the day to do the work which took months. Rick rarely answers his phone and his voice mail is always full. He has no place of business and works from his home and rental storage unit.
