Wingates Quality Watches - Tick Tock - Robert M Wingate, Ripped Off never issued credit, can't prove they did, refuses to cooperate to settle matter ripoff Dallas Texas

Over a year ago, my wife bought me a watch at Wingate's DBA Tic Tick, of 12900 Preston Road, Suite 1010, Dallas Texas 75230. Wingate's operates as an on-line distributor of high end watches. My wife paid for the purchase with a credit card, ($ 895) but did not have it shipped as she was uncertain if I already owned the watch. She presented a picture of the watch to me on my birthday, and a few days latter I asked her if I could exchange it for another or return it. as I already had that model.

I called Wingate's, they did not carry the watch I wanted, and was told no problem, we will issue a credit.

Shortly thereafter, we had a death in the family, which distracted our attention from daily activities for the ensuing months, as a result I never went back to check that Wingate's did what they promised.

While assembling some tax data, I noticed the charge and looked for the credit. I looked through my statements for more than a year and found none. I called my credit card company and they had no record of a credit. On Monday 4-16-07 I called and asked for Mr. Wingate, the staff would not let me talk to him and instead was referred to a rather rude lady by the name of Sharron ( Wingate ?).

I calmly explained the situation to her, to which Sharon's immediate reaction was it was too old and she is too busy. After imploring her to look into the matter, and after doing a few minutes of research told me that a credit was issued to a card with the last 8 digits 1017-6895.

I explained that card is not mine, and not the one that the transaction was processed on. I asked her to provide me with a copy of the credit, she told me it was in storage and she was too busy, but perhaps she would get around to it. She asked me to fax all of my past statement to her and she would look into it.

After a week, and no response, to several emails and my faxes, I called to check on things, was met with a surly attitude, and was told that the matter was too old and they were too busy. I then called back to talk to the owner, who promptly told me that I had to work with Sharon, and did not even want to hear about it.

I have tried to contact the owner on many occasions, my calls get screened and they just hang up on me.

I contacted my bank, sent them a copy of the email where Sharon admits that they issued a credit, but the credit card company can't help as the matter is over 90 days old.

I feel that I have been defrauded here, no watch, no credit, nor will they take the time to prove to me that they issued the credit. Even if they did, it appears that the credit went to another account, not mine. Mr. Wingate apparently does not care what goes on in his business enough to get involved, or to try and do the right thing here. He is obviously complicit in this scheme to keep my money.

They have had the use of my money, for quite some time, and I plan on pursuing this to the end. I suspect that if you dig, this is not the first problem with this company.
