Warning: Robyn Milewski is not a fair business women.

Google her name and you will discover, as I did too late, that she has a history of bad business transactions.

I had an agreement with Robyn to provide a set of photographs at a set price. I delivered on time and on budget. The shots were approved and used commercially. Robyn stiffed me out of the last $500 of payment and then pulled another $500 out of my PayPal account 110 days later.

It is my opinion you should NOT do business with her.

___DETAILS____

Robyn Milewski of Pure NRG Bars hired me (davo) to photograph her vegan baked goods for sales sheets and web use. She sent a member of her staff to direct the shoot and arrange the food product. We had agreed to a day rate of $1500 and that included light product retouching and background removal. The day of the shoot everything ran smoothly. Robyn stopped by to see the studio and approved of the style and lighting of the photography. At the end of the day they had a few extra shots that were not on the list and I agreed to throw those in for free. I had been paid $1000 of the agreed upon $1500 with the promise of being paid the last $500 the next week. I delivered the retouched master files and requested my final payment. I was given some reason why the payment would take a few more days and I decided to turn over the files anyway and wait to be paid. When the images were delivered, they were approved and everyone was very happy with them. After a couple more inquires about being paid Robyn called me with a list of complaints about the photos. Pretty quick into this conversation I realized it was an attempt to beat me out of the remaining money. Each of her complaints had to do with the way the baked goods looked NOT the photography of them. Things like "the bars look dry" and "you should have taken the pie out of the pan and cut a slice out"  I reminded her that I had cautioned her staff about baking the product too far ahead of time and things like displaying the pie as a cut slice is a creative decisions her company would make. I wouldn't cut into a customers product without being told to do so.especially since we only had one pie to work with. Robyn sent one of her sales people to direct the shoot and I followed her direction on each photograph. In this phone call Robyn used the words: "I feel like I'm being RAPED being charges $1000 for these photos" at this point I knew she wasn't interested is resolving any of her issue. She didn't want to hear about things we could do in retouching to correct the situation. She was apparently only interested in beating me out of the last $500 bucks. Which she did. For me it wasn't worth the hassle so I let it go.____

Until now. 110 days later, and after using the images in her sales materials Robyn filed a chargeback and pulled another $500 out of my Paypal account.___

This action I can not stand for and now it's a matter of principle.

If she doesn't like what her product looks like in the photos how is that my fault? The shoot day is the first time I had seen her product. I don't know what her vegan bars are supposed to look like. They were delivered and handled by her representative. Her person approved each shot as I went along. ____

I did my job- I need to be paid as agreed.___

If a photographer does a portrait job and 110 days later the client decide she shouldn't have worn blue eye shadow in the pictures. Should the photographer then not get paid?   I photographed the product I was given in the style we agreed upon as directed by a Pure NRG employee. - enough said.____

----------------------------------------------------------------

Even her employee think Robyn is unreasonable.

Here is a letter she sent me:

January 14, 2010

To Whom It May Concern:

Davo Photographic was hired by PureNRG (Robyn Milewski, owner) to shoot product for catalog, line sheet and internet usage on September 21, 2009.

I was Ms. Milewskis assistant at the time and was present for the photo shoot. Ms. Milewski also stopped by the studio and saw the set-up (background, lighting, etc.) and had no corrections to make. Davo and his staff not only shot the original product quoted, but added additional shots at no extra charge.

Everything was photographed per our (PureNRG) request in a professional manner. The pictures were returned on two sets of two disks to myself and Ms. Milewski and were subsequently used on PureNRGs website and on two line sheets.

The entire cost for the day was $1500, which Ms. Milewski agreed upon before we began. Ms. Milewski failed to pay the entire $1500, only paying by PayPal, $1000.

I believe that the job was done correctly and not only should full payment have been received, but that this chargeback to Davo Photographic is unwarranted.

Please call or email me if you have any other questions. Sincerely,  Jennifer Perkins

Issue resolved------Everybody satisfied

AUTHOR: Davo - (United States of America)

POSTED: Tuesday, January 19, 2010

I was contacted today by Robyn Milewski.

We had a calm professional discussion about her issues with the photography. On some points we agreed to disagree and on others I see where she has some legitimate concerns. I explained how some of these problems could be taken care of in retouching but other items may need to be reshot.

I then offered to drop the original price from $1500 down to $1000 and Robyn agreed to reinstate my PayPal funds.-------Issue resolved------Everybody satisfied.
