It's very disheartening that these people go so far as to continue to talk in circles and  lie intentionally attempting to hurt my business as well as me personally. WIth ZERO PROOF. THEY HAVE NO PROOF BECAUSE IT"S NOT THE TRUTH!! I invite you to investigate me and my business at all levels. You will have no doubt who the theif and liar is then. All I can say is they ought to be very thankfull that I am a Christian. The problem they have is everything they have claimed to be true is FALSE and  I have the documented proof that the Cooks are the CROOKS. I have a their bank confirmed, documented signature on the back of my canceled check. Tell me, since they said it wasn't about the money, why would they cash the refund, keep my horse, then file a lawsuit,trying to get even more money,  then still have the gall to try to extort money from me months later? THEN to add insult to injury, KILL MY HORSE!! In defense of another false claim they have made, it was them that had her shipped all the way from Texas to California in her so called condition. If they were telling the truth, they would have abided by our contract which plainly stated that it was to be governed by Red River County in the State of Texas. You see that's exactly why they didn't and still haven't come to TEXAS because they knew I was unable to come to California to defend myself andthey wouldn't have a chance in a Texas court where I would have had chance to provide my OVERWHELMING EVIDENCE of my brutal honesty and  their utterly disgusting indiscretions. What they have done is Underhanded, Hostile, and downright immoral.  Please visit my website and see for yourself. Marla states that she sent a refund check and has a cancelled check. If this is the case, she had someone else cash it, because we never recieved a dime back from her, which is why we went to court. We didn't care about the money but instead wanted to protect other "clients" and horses from the same result that we had gone through.

We did much research before going to court and the courts deemed it was legal to press charges in CA because we lived here. The vet states that he gave the papers to Marla and that he had told her NOT to sell the horse NOR to allow it to be shipped. She did both. She also never said anything about the mare being an embryo transfer only mare and the paper did not say anything to the contrary. Had she either a) told us or b) had the correct vet documentation, we would not have bought the mare. Also the vet that we got papers from said he had only worked with Marla a few times prior and did not know her very well. Now why would she do that instead of going to the orignal "attending veterinarian" listed on her site? Because she had something to hide.

After a subpeona from her attending veterinarian, we recieved medical files showing the mare was on very heavy pain killers and antibiotics. The staff at Norco Equine Hospital said that the mare had been in this condition for months prior to our purchase and were willing to testify to this in court.

Her claim that we refused to send her the papers back so we could collect her eggs was a lie. When we called her to discuss the conditions of the mare (while the shipper was still on the property) she claimed the mare was "fine" and that it was no longer her problem. We knew that we could not collect eggs from her and only wanted her to live out the life a champion should instead of the crippled, starving horse Marla had sent. And it was 3 weeks later that she coliced, no longer. She was euthanized because the vets, Norco Equine Hospital (some of the best in southern CA) said that there was no way she could recover and the kindest thing to do was to put her down. The papers were sent immediately to AQHA and returned to us marked as deceased. There was no reason to send them back to Marla.

She tries to lay blame on the shipper who had her "9 days" prior to shipping. This is a lie as Ron confirmed that she was picked up from her vet. And the Xzylazine record came directly from her vet with that date....how could I get the math wrong? Then she tries to lay blame on us...the mare had food, water, and all the care she could get in a 12 X 16 stall. She was seen by vets and pampered daily. She was starting to gain a little weight when she coliced. And anyone who knows horses knows that horses don't get into that body score in a matter of days or a few weeks, it takes MONTHS.

The point of the matter is that we never recieved a check, cash or otherwise, a champion died because a breeder tried to make a few bucks, and we have ALL of the documenation that shows that Marla has lied about everything she stated in her rebuttal. She tries to hide behind her lies by bringing Relgion into play (sorry, even God fearing people make mistakes) and blaming everyone but herself. Anyhow, the point wasn't to upset her, but instead to make sure others are very aware and do their OWN homework prior to purchasing a horse from her. It may have been a once in a life time problem with one of her horses, but I don't know. Yes we have our own website now, but ALL of our horses are healthy, ALL of our clients are happy, ALL of the vets LIKE to work with us, and ALL of trainers that we know appreciate our program commend us on our animal care. And the reason these reports were done so long after the fact was that I was not aware that these types of websites exist and I did not know that she had responded.

I find it hard to believe that a "Christian woman so concerned for the safety of a horse" would let it travel so far if it was in that bad of condition. Her vet and our vet both said that the mare had been in said conditions for MONTHS before we purchased her. Just because a "web designer" sees pictures does not mean that they are accurate. If we had seen current pictures we would have never purchased the mare. This woman is a fraud, animal abuser, and a lier. But if she wants to hide behind it, that's fine with us. God will judge her in the end. And the gentleman from Phanon farms never boarded the mare....picked her up from a "vet". He says to this day how he wished he had called animal control at that time. Too bad he didn't.

First of all. I am a Christian and I have hundreds if not thousands of references to my good character and business ethics. As a matter of fact, Leroy and Deidre Cook are the only people that I know of that have done businesss with me that claim to be unsatisfied. They, in fact were well aware of Freckles' condition, as I was nothing less than BRUTALLY HONEST IN OUR CORRESPONDENCES. I have our first email, in which I noted her problems UP FRONT!!

I am well known locally for my devotion to animals, especially those who have lived less than easy lives before coming to me. I am a caregiver. It's what God put me on this earth to do and I'm good at it! I volunteer my time and services to many equine/animal rescue organizations.The Cooks say they reported me as an animal abuser to our local authorities and they refused to do anything about it??? That's a laugh. I'm sure the COOKS were met with quite a bit of skepticism on their outrageous claim that I abuse animals, as my reputation speaks for itself. I am one of the few people that the local Sherrif's Dept. can call who will jump up at 3 am in the morning, and hook up my trailer, drive 20 miles and stand in the middle of a busy highway, not even taking time to change out of my pajamas, trying to help a broke-legged horse out of harm's way after being hit by an 18 wheeler.. then load the horse by myself which took great effort with two broke legs. I had to almost support her whole body weight to help her in the trailer.. and then, haul it to the vet and offer to pay her vet bill the next day if no one claimed the horse.That's just one instance to bear testament of my feelings toward animals. I welcome any professional scrutiny of my animal's wellbeing any day of the year!!! I have an overflowing scrapbook of rescue horses that I have bought and saved.. I have many before and after pictures and am proud to have won almost all of my battles with my rescued animals..Most are happy and healthy today and are in loving attentive homes. That's all I ever provided and wished for Freckles ...

Back to the subject at hand.. Freckles Nugget...I have documented proof that every negative thing deidre and leroy cook stated about me and our transactions is a FLAT LIE. I have a written contract, phone records,vet records, personal references, email records, canceled check, etc.. please email me and I'll supply this proof to anyone at any TIME. Their first claim is that I guaranteed Freckles breeding sound. I did NOT! I strictly guaranteed that Freckles was still cycling and producing viable eggs according to two different very experienced and knowledgable veterinarians. Confirmed via sonogram. My direct advice to the Cooks was that she be used strictly to collect eggs from to be used in an EMBRYO TRANSFER PROCEDURE, implanted into a recipient mare. I explained to them in our first correspondences that My reasoning behind this was that it would be too painfull for her to carry a foal to term herself considering she was very arthritic in her front feet due to founder that occurred before I purchased her. I have proof of this in my extensive vet records and email records. I even have the vet records from the people I purchased Freckles from as we use the same veterinarian.

Their next claim is that they had a vet check done. I had two vet checks done, the first one, to which they are referring, was done at the Dekalb Animal Hospital in Dekalb, Texas. She was deemed suitable per their expectations by both vets. I also had both the exams done at seperate vet clinics. One while they were deciding whether or not to purchase her and one after they purchased her just for her safety's sake when she was about to be loaded by the shipper. BOTH VET EXAMS WERE DONE AT MY EXPENSE! I have the canceled checks. They also claimed that the first vet said I doctored or changed the results. That would be impossible since the Vet Check Results were faxed to them immediately following the exam by the vet assistant straight from the vet's office and was never in my possession until after it was sent to them. I also have records of this. I don't believe the vet said that I changed those results!! If he did, He's a liar just like the Cooks and I'm sure it was a last resort attempt to cover his own tail, because they were making threatening phone calls, harrassing the vet about a lawsuit. They also claimed this same vet said he would never work for me again.. Which is also false. I still do business with this particular vet on a regular basis and am SO TRUSTED to have a CHARGE account with them. Now does that sound like someone who doesn't ever want to do business with me again? EXACTLY!!

ok, on to refuting the next claim...That they chose the shipper... I was adiment that Ron Fillmore be the shipper in Freckles case because he had just a few weeks prior shipped a risky 8 month pregnant mare to California for me and he took good care to rest her often and she had no complications. I contacted Ron myself and told him of Freckles condition and noted her specific feed and care regimen, and I let him know I expected it to be followed to a T, as any added stress could have a very negative effect on her considering her condition and age.. WHICH BY THE WAY WAS 26!! They didn't care to mention that part in their LIES. The average life span of a horse is around 20 years.

The Point is THEY KNEW AND HAD BEEN TOLD EXACTLY WHAT TO EXPECT. I even have documented proof that I provided them a height and weight as noted by the veterinarian at the time of her exam. THE COOKS only decided to contact me and complain about her condition many days after receiving her. I was very upset that they claimed to be unhappy with Freckles and I enjoyed my status of NO UNSATISFIED CUSTOMERS, So I AGREED TO GIVE THEM A FULL REFUND. But they tried to get me to pay for the shipping and expenses, right down to the feed she ate while in their custody.. Then I got suspicious that they were just trying to get over on my good nature..I knew complying with their demands, would not be fair to me, or Freckles.. they expected me to give them all their money back and let them keep my beloved horse too, but I didn't want her to suffer another gruelling trip cross country, back home, So I called them and offered a FULL REFUND MINUS THE COST TO SHIP HER BACK TO ME> THEY AGREED AND PROMPTLY CASHED MY CHECK!! I have the canceled check and contract, which they are in breech of in every aspect!!!. THey agreed to send her papers back to me so they would be rendered unable to use her for collecting eggs, the purpose which they intended

Weeks later they contacted me in the middle of the night and reported that they had coliced her and reluctantly carried her to the vet and asked if I was going to assume responsibility of her expenses. I promptly told them they should do everything they could for her, but that I WAS NOT RESPONSIBLE FOR THEIR HORSE!! They chose not to assist her any further, but to COLDLY SNUFF OUT A CHAMPION by euthanyzing her. I would not want her to suffer, but I question their actions at every angle.... I demanded pictures of her when they first complained, that she was emaciated etc. The pictures they took and sent to me was of Freckles standing pitifully in a 10 by 10 panel lot in the direct California HOT SUN, It had a full spectrum view of the pen and there was no water, feed,hay or any trace of remnants of sustinance available in that pen.. That was the picture they took themselves and sent to me to prove her emaciation... NO WONDER SHE LOST WEIGHT AND COLICED IN THEIR CARE!! The only thing that picture proved to me is that LEROY AND DEIDRE COOK BOUGHT A HORSE THEY DID NOT INTEND TO CARE FOR!!!
I took pictures of her the day before I put her on the shipper's trailer and sent it to them before she was picked up..and I also went to the extra effort and expense to have another vet exam performed just before she was put on the shipper's trailer to make sure she was healthy enough to travel that LONG DISTANCE. Do note that the shipper was in possession of her 9 days prior to leaving Texas on his way to California.

Another of their claims is that I DOGDED them?? ANOTHER LIE>> I have phone records to prove 30 minute long talks on my cell phone.. and documented proof that I answered EVERYTIME THEY CALLED and spoke to them even when they harassed me by calling me time after time just minutes in between, Even late at night... My phone records also document their NOT CALLING FOR OVER A MONTH BEFORE THEY COMPLAINED THAT I SOMEHOW MISREPRESENTED THE HORSE TO THEM>>>>

LEROY AND DEIDRE COOK Contacted me in Dec. of 2006. THey purchased Freckles a couple weeks later. Freckles Nugget was examined and shipped shortly after on January 22nd 2007. My vet administered Bute and Penecillin just before she got on the shipper's trailer. The Bute to comfort her arthritis and the Penecillin as a precautionary measure for shipping fever, a cold like ailment, commonly suffered by horses and cattle traveling long distances, as per the name SHIPPING FEVER! She was boarded at PHAON PHARMS in care of Ron Fillmore(OWNER/SHIPPER) for approximately nine days before being shipped to the COOKS.

Another of their claims was that Freckles was given the sedative Xylazine... ANOTHER LIE SURPRISE SURPRISE>> THE LAST TIME SHE WAS GIVEN THAT MEDICATION WAS ON MAY 25th, 2006.. YOU DO THE MATH>

I want you to know that I was just recently made aware of their false accusations and I also want you to know that they filed this report in 2009 years after the incident and only after they had launched a WEBSITE SELLING HORSES!!! They were granted a judgement against me in California. THIS WAS ILLEGAL AS OUR CONTRACT WAS BASED IN THE STATE OF TEXAS AND WAS DUELY STATED ON THE INVOICE/ CONTRACT TO BE GOVERNED BY THE STATE OF TEXAS, COUNTY OF RED RIVER!! THEY CHOSE TO SUE ME ONLY AFTER EXTORTING MONEY FROM ME AND BECAUSE THEY WERE AWARE THAT I WAS ILL AND I WAS NOT ABLE TO GO TO THE EXPENSE OF FLYING TO CALIFORNIA AND HIRING A LAWYER TO GO AS WELL. MY EVIDENCE SPEAKS FOR ITSELF AND I DARE THEM TO COME TO TEXAS. I WILL SEND THEM BACK TO CALIFORNIA WITH THEIR LYING TAILS BETWEEN THEIR LEGS. AS WE BELIEVE IN THE TRUTH AROUND HERE!!!

FRECKLES DIED AT LEROY AND DEIDRE COOK'S HAND IN MARCH 2007.
I NEVER RECEIVED HER AQHA REGISTRATION PAPERS AS THE COOKS AGREED WHEN THEY CASHED MY REFUND CHECK>
NOR DID I RECEIVE ANY DOCUMENTATION THAT THEY EUTHANIZED HER VIA A LICENSCED VETERINARIAN> FOR ALL I KNOW THEY LET HER STARVE TO DEATH OR PUT A BULLET IN HER HEAD> WHATEVER THE CASE> GOD KNOWS WHO LOVED HER AND CARED FOR HER AND SHE DESERVED A BETTER ENDING. I BELIEVE THEY SHOULD BE HELD ACCOUNTABLE FOR LYING IF NOT HERE ON EARTH THEN BEFORE GOD HIMSELF!!!


The Cooks should be completely ashamed of their conduct. FRECKLES was happy here. I was dedicated to her wellness and I spared no expense for her comfort and wellbeing.

She keeps them from the killer in order to give them a good life and rehabilitate them the best she can. She spends alot of money on vet bills, feed, hay and anything else that needs to be done for these older ladies in order to give them a good life. I have never known her to be dishonest with anyone about her horses.

When this was all going on, she and I talked about her worries about this mare traveling so far. She was very concerned that the trip would be hard on her, but trying to be the good person that she is, she decided to go ahead and let her go to a supposedly good home. She was devastated to hear that these people put the mare down shortly after getting her. She breeds quality horses and has prices that are fair so that anyone can fulfill their dreams of owning a nice horse.

I believe this report to be fraudulent and a defimation of character case. If it were me, I would definitely look at filing legal consequences for blatantly stating opinions that are just that, opinions and airing dirty laundry on the internet.
