On July 20, 2010 an $8000 check was cashed by a Home Improvement company we had doing some work on our house. This was full payment in advance for 6 windows from Royal Tech. One of the windows arrived manufactured incorrectly.
Royal Tech was paid for these windows and does not dispute this fact.

In December 2010, the contractor was no longer working on the project. Several items were in dispute, having been done poorly or incorrectly. The BBB was involved in discussions, but resolved nothing.
When he had done all he was going to do, minus the replacement of the incorrectly made window, he wanted more money from us.

Since we had not yet received the warranty paperwork or any receipt, other than his handwritten date/check number, we withheld $1500. This is the amount of the federal rebate on the windows.
We agreed to pay him this amount, when all windows were correct and functional.
We never heard back from him.

On April 19 2011, I contacted Curtis Smith at Royal Tech.
We spoke about the problems with a few of his windows. I informed him we were no longer dealing with the contractor. He was quite friendly, asked for details about the windows. (Now up to 2)
He stated that one of the windows had been manufactured incorrectly, and the one with the broken blind might have as well, with the cord twisted or tangled causing it to snap. He said he even knew who had made it and would retrain him to keep it from recurring. He asked for photos and measurements, which I sent.
He agreed during that conversation to send me the parts necessary to make the repairs: This never occurred.
 
In the six weeks since, we have two other windows with issues: One doesn't slide closed unless extreme force is applied and the blind sticks half way down in another; if you raise and lower it several times it eventually drops.

Since he claims to have a 10-year warranty on the windows, has been paid in full for almost a year, and has already admitted liability, I asked him to make good on his warranty.

He refuses to do so unless I pay the contractor $1500, by putting the money into escrow with Curtis's lawyer.

Fact. He has received full payment.
Fact. Financial issues between myself and my contractor are not his concern.
Fact. He claims to have a warranty.
Fact. He already admitted to manufacturing errors in 2 of the windows.

Bottom Line
He needs to have the 4 windows repaired and/or replaced or his stated warranty is a fraud!

Another window bites the dust

One of the dining room windows no longer raises and lowers. Love that non-existent warranty. Where is the Michigan Attorney General when you need them.

I bought three Royal tech window in the late fall.I soon noticed that the plastic film was turning bluish ..cloudy like. I contacted Royal tech about this problem.I talked to curtis the owner??? I guess... who was RUDE and tooting his own horn about being top ten in the business.I know it is not for the quality of these window or customer service!!!!! I would not recommend Royal tech EVER !!!! I was ripped off!!!!! Thank GOD I only needed three windows.

Ignorant or dishonest

The owner of this company continues to get into the dispute between myself and my contractor.
He also continues his blatant lies and misstatements. During my first conversation with him, he asked detailed questions and did indeed state a manufacturing problem that required retraining. He provided my Purchase Order number for further reference.
He also stated the contractor had not been in contact with him regarding my window problem, only a problem he'd had with windows he'd ordered for his personal use.

The owner, who was fully paid at time of purchase, continues to interject himself in matters that are none of his concern.

His sole concern should be backing up his warranty -- If he actually has one and the financial means to do so.

Giving him the benefit of doubt, that he was possibly just ignorant of the facts, and not blatantly disregarding his "supposed" warranty, I sent him a detailed financial listing of what transpired between the contractor and myself. This was above and beyond, but he has continued to unreasonably ask us to put $1500 in escrow before he honors his "supposed" warranty. And since he keeps mentioning a fictitious $5000, we thought he might like some facts. Instead of being educated by the truth, he just continues down the same path.

Following is the email he was sent last week.

The owners and my name were removed and the contractors name was replaced by the contractor:

Since you want to continue to get involved with issues between the contractor and I rather than just honoring your warranty, I'm enclosing the payment resolution, so you can see where the contractor continues to lie when stating numbers to you.

                          $ 536.33    -Roxies surgeries to repair paw due to neglect with gutter sharp side up in yard

$1500.00     final balance due when replacement window is installed and all receipts/warranties received
 
This is from December 2010. We gave the contractor the $3016.14 check and told him to contact us as soon and he got the window. We never heard from him. I waited until April of this year when the second window had issues before contacting you. Now we are up to four of your six windows having issues.
 
I am also enclosing the code requirements for the rolled roofing requirements, which the contractor did not meet and we had to pay another roofer $1500 to replace.
 
The rolled roofing he installed is class C and the following Colorado Springs ordinance does not allow it:
 
RBC303.4.77 Section R902.1. Amend the section as follows:

One-and two-family dwellings shall have a minimum roof covering of class A excluding solid wood roofing products. Accessory structures shall have a minimum roof covering of class B.
Add the following to the end of the paragraph:  These requirements shall also apply when completely recovering or replacing aroof covering in accordance with section R907 of the International Residential Code, 2003 edition and section RBC104.4 of the Building Code.


And we let him slide on that $1500 roof replacement done by a reputable roofing company.
 
Do you understand the only reason we came up with the $1500 withheld, was it was the amount of the rebate. It had nothing to do with the cost of the window itself.

Since he wasn't going to do any other work, we figured by holding this amount, we would ensure his prompt return, pay him afterwards and be done.  Why would any reasonable person not return and replace the window and get final payment. We were going to withhold the entire balance until he fixed it, but he thought that was unreasonable so we relented.
In hindsight, had we known he wouldnt bother coming back, we would have held it all.
 
We have four of your windows with problems, just fix them.
He'll still get the $1500 balance when all windows are in good working order and we get receipts/warranties. Nothing has changed -- We agreed to it.

We honor our agreements.

Here is the email he referenced regarding my blogging about him. It was sent prior to the one listing financials. It is my right to expect resolution and I stand by every word:

I have a copy of the receipt signed by the contractor and the cancelled check, showing the Windows were paid in full before they were ordered.

If your warranty is a lie and you are not a man of your word, I will continue to blog, contact media and governing bodies until a satisfactory resolution is reached.

It's a shame you and your company are not what you represent yourself to be.

Sure hope the window guy makes windows better than he writes

I sure hope the window guy makes his windows better than he writes, because he can't write a proper sentence worth a d**n! And if this customer's experience is for real, he can't make windows any better than he writes.

This man said he owed his contractor 5,000.00 dollers and is not gonna pay him because of his roof as for the windows the part was shipped to the contractor and this man said he was gonna bad mouth our company he also said that he owed him 1500 on the windows and would pay him when he gets the part all he has to do is put the money in a esscrow accout and he will get his part that was purchaced by the contractor and for the record i never said that the window was made wrong and is he an exspert on manufacturing of windows makeing statments can cost you.  He told me that he was going to bad mouth my company on line.  The windows have been in your house since july of 2010 and it is know june of 2011 almost one year your claim on your call was around 4-15-2011 after we checked out evreything and foud out that you owe 1500 on the windows almost 12 months later and the bbb did nothing is because you owe 5000.00 to your contractor pay your bills and you will get your part from him he is the one on record of purchasing the windows we only have him on file.   you were offerd to put the money in a escrow accout that way you dont have it and the contactor does not have it.  You must not have the money for sure  call your contractor for your part.
