RPM Michael Jordan Nissan - Steve Martin Would not refund a deposit on a cancelled order even though it states customer can cancel oder before delivery for full refund of deposit! Ripoff Durham North Carolina

I left a deposit on a car on sunday july 29th. agreement was faxed to me it says subject to availibility and delivery and to customers approval of order and deposit and that if for any reason customer not satisfied deposit will be returned and order cancelled. Please note that $275.00 was added to sell price because I was told car was in GA, and was to be flat bedded to dealership! Afterwards I received a call from steve martin on tues. july 31st. late afternoon early evening stating that he was unable to get that car, but he could get one from baltimore/wash. area. I told him I'll get back to him and let him know. Later that same day approx. 2 hours later I called steve martin and keft a message for him to cancel order and refun my deposit.I received a voice mail from him stating no problem. Now he refuses to refund my deposit! saying that he has the car and it was driven to is dealership. Please note I never authorized that in any way, and order was cancelled before hand.
