Ruelala made an offer to sell a watch, an Oris Big Crown Pointer, at a certain price, $499.00, plus $9.95 shipping for a total of $508.95.

I accepted the offer by tendering payment in full to Ruelala.

Ruelala accepted my payment and sent a confirming email expressing their acceptance of my offer of payment. They also gave me an estimated delivery date.

At that point, Ruelala and I had a binding contract.

Both sides indicated in writing that they were ready, willing and able to perform their end of the bargain.

The contract required Ruelala to deliver the watch to me and required me to pay for the watch.

About three days after writing me to acknowledge my order, Ruelala wrote me again to say they were cancelling my order. Their refusal to sell me the watch had nothing to do with any financial problems on my end.

They offered me no compensation for their failure to perform their end of the contract other than a refund of my money, which I did accept.

I then wrote them a series of emails and attempted repeatedly to reach them by phone, to no avail. They did respond to emails, but with canned responses, not a real response to my complaint. They returned one phone call by leaving a message on my answering machine, but never returned any of my subsequent calls to them.

After I complained to the BBB in Boston, Ruelala.com offered me $25 compensation for their breach of contract. I did not accept it.

They still refused to respond to emails or calls.

Ruelala's notification that they would not deliver the watch, even though I had offered full payment for it, was a breach of our contract, just as it would be if I failed to perform my end of the contract, which is payment. Ruelala absolutey refused to perform the contract.

It is Ruelala's contractual obligation to comply with the contract by delivering the specified watch at the specified price.

I think it is extremely dishonest of a company to offer merchandise, accept payment and acknowledge the order and then turn around and refuse to honor the contract. If I had received the watch and then refused to pay for it, it is a certainty that Ruelala.com would come after me for payment.

They just walked away from a deal and refused to talk to me about their behavior. I think they owe me the watch at the price we agreed on.
