Mr Bain, As stated in our prior e-mail, you were not lied to, it's hard for any breeder to predict the exact date a female will deliver and what color or sex she will have. As our deposit contract states, in the event the color or sex of the puppy you have requested is not available, your name will be placed on the list for the next available upcoming litter, Females can have the pups early or carry them over several days, this is out of our control. Your wife was told this morning that our vet technician had informed us that our next litter is due at any time now, and we would contact her just as soon as the puppies arrived, she seemed fine with our responce and later that afternoon she called our office and said she had found a puppy elsewhere. As our legal and binding contract states, deposits are Non Refundable, our contract signed by you will stand up in court in our favor, it has in the past. This is the reason most people in business have contracts. Example, we had a client last year that placed a deposit in full for a puppy, when it came time to pick out there puppy they desided they no longer wanted her, long story short with our signed contract that states deposits are non refundable, it went in our favor and she forfitied her deposit. No where on the deposit contract does it state that we refund any of the amount we recieve, the deposit is left up to you if you choose to pay more than half thats your choice, weather it's half or the full amount, the fact remains, it's a deposit to hold a puppy of your choice. The litter of Black Labs did arrive, you were contacted that the litter had been born and there were three black males for you to choose from, we filled your order and you refused your puppy. Due to our policy that clearly states deposits are Non Refundable, as far as Rush Kennels is concerned this matter is closed. As far as ripp off report, our many customers understand that anyone that is in business is bound to recieve a complaint from time to time, our reputation speaks for it's self with many testimonials posted on our website guestbook from our customers, this say's it all about what customers think of our facility. Rush Kennels handles all complaints in a professional manner and reply with a rebuttal letter concerning our policy, we back up all complaints with documentation.
