I called Michael Taggart and he could not help me but, he gave me some very sound advice and I am going to follow it. He also had alot of compassion for my situation. In 3 years I have buried my husband, had a stroke , had breast cancer and just buried my daughter and Sacor Financial just does give up. I am making payments to them and they continue to harrass me and I guess they have a judgement and I do not even know how much that is. They continue to serve me papaers, threaten on a regular basis. My payment was 12 hours late and they are threatening to pull me in for a credit exam again. They are not reasonable and I was going to try to contact who ownes this company  this David tells me, he appreantly works there that  it is a group of people. My bill has grown from 2004 of 17, 000.00 to over 56, 000.00. I am 60yrs old it is going to take me 9years to pay this. If they ever let me breathe.  Enough said but, Michael Taggard is the answer for folks who are lucky enough to live in California and are able to hire him to help you. Thanks so much!

Yes and No...

Yes- The CA statute of limitations (state law 337) has expired on the debt. In CA the limits are Oral-2 yrs; Written-4 yrs; Promissory note-4 yrs and Open End Account-4 yrs. Reference the following website  http://www.creditinfocenter.com/rebuild/statuteLimitations.shtml

No- The statute of limitatations controls how long after the last payment on a debt that you can be sued for the debt, not how long it takes for the debt to be uncollectible. There are 3 things that cancel the debt and stop collection action: pay the debt; going through bankruptcy if the debt is dischargeable and death of the debtor(s). The creditor can continue to try to collect the debt until one of these 3 happens.
