In March of 2003 SAFCO reposessed my 1998 White Jeep Grand Cherokee Loredo. When I got it back the next day there was damage done to the vehicle and an item stolen from the Vehicle.

American Recovery picked up my car in the middle of the night, left nothing telling me that they took the vehicle either by phone or on the door of the apt. When I went in the next day to pay and retrieve my vehicle I noticed the following, which has on numerous times been brought to their attention through SAFCO the finance company whom hired them to tow the car.

1. right Front Tire Flat and full of nails- I replaced the tire after making American Recovery Agent pump it up. yes they were going to say nothing and let me drive off with a flat with two children in the car.

2. Scratches on the bumber that appear to be from brushing up against another car that were NOT there before the repo.

3. Alighnment was serverely knocked out on the vehicle so bad the wheel shakes and immediately pulls to the right when you let go of the wheel.

4. My son's 100.00 skateboard is missing, this child saved and saved for it and now it is gone and noone will claim responsibility for it either.

I tried to approach these things with management in the ft lauderdale office off of Oakland Park Blvd, Supervisors never appear to be in their offices and when such as Mr Holder do get on the phone with me they promise to check into it and call back. Once he call back and told me there was nothing that could be done, Today I talked to Mr Holder again and he promised to call back by 5pm it is now 6:06pm and still not a call from the man. I warned him a report would go in at this site if resolution was not reached, and here I am reporting it.

That day they charged me a 500.00 reposession fee to have the car towed, 69.00 for inventory of the items in the car, and boxing of such items as well as other fees. For that I expect that the damage done be corrected as my vehicle was in SAFCO's care from the minute they had it reposessed and they ARE in my opinion responsible for all damage incurred.

I dont care about the tire, I dont care about a couple tiny scratches I can deal with that. BUT the alighnment and Skateboard I do care about seeing it creates a dangeroud situation for driving as that car is a higher profile car and can flip easily, as well as the skateboard for my son who didnt ask for it to be stolen.

SAFCO really should think about the type of people that they hire to reposess their customers vehicles, this is clear and outright neglegance and will NOT be tollerated.

The time for being nice is far over with in this matter, my next step is a complaint with the motor vehicle safety commission and assessment by them of the damage done.

Well Yeah I have the RIGHT to remove personal property before they take the car but that is a little hard when they come in the middle of the night , hook it up and tow it away without even as much as a knock on the door to give me that chance.

I talked to Mr Holder Monday he PROMISED me that he would get back to me by days end, he was attempting to get the auto garage at Anything On Wheels where I bought the car to repair the damage, yet again no phone call , here it is friday and still no call.

Monday I go to the State of Florida Safety Commission for the DMV and see what they have to say about this whole thing and NO my insurance wont take care of it as I was not with this company at the time of the Repo.

Safco's towing damaged it , they will pay for the repair or I go to whatever sources I can to make sure they do.

#1 Consumer Suggestion

They almost always repo without warning.

If you're behind on car payments, any company is likely to repossess it without warning. If they warned you, it would make their job much harder. If a repo seems imminent, do not keep any valuables in the car. They don't have the right to keep this property, but someone along the way will ALWAYS steal it because you can't prove what was in there.

You also have the right (before repo, not after) to remove anything you've added since you bought the car, such as stereo equipment or high-performance parts. Again, this stuff will likely be stolen by repo men. If it does remain on the car when it is sold, it will not increase the sale price enough to be worthwhile. They always claim the car sold for a pittance and you still owe nearly the full amount, even if it was in perfect condition.

Your insurance might pay for the tire and alignment, but it would be a bad idea to file this claim. The insurance company will use it as an excuse to greatly increase your rates.
