I was hit by a Safeway insured on Memorial Day. He rear ended me in front of my apartment as I was about to turn into my driveway. He didn't speak English and had an out of country drivers license(Mexico). I refused treatment at the scene, but did go to the ER the next day. I have been seeing doctors almost every other day since the accident.
After the accident, a friend told me that the Atlanta news did a story about Safeway and their crooked practices...I was thinking, GREAT!!!! Then I started to do research on the company and found this site. I immediately started calling the corporate offices in Illinois, to see if that could help expidite the claims process a little bit.
I did get someone to look at my car 2 days after the accident. She totaled it. Now I am dealing with my adjuster, Laurie Kuter, to get some kind of numbers. She told me it will take WEEKS AND WEEKS to get a police report. My agent at State Farm said it shouldn't take more than a couple of days to a week, once the car is seen and determined totaled.
I am also injured from this accident, lost my jobs because of the accident and going broke from the expense of this accident...AND IT WASN'T MY FAULT. I can't file under my uninsured motorist, because this guy has insurance. But the insurance company doesn't seem to want to go forward with my car. I have no idea what to do. I need to get a car (in Atlanta its a must). My car seems to drive, but I don't even know if its safe.
Is there anyway a class action lawsuit can be filed against this crooked company? There has to be a way to stop this injustice to their consumers(the poor people that cough up the insane premiums) and the vicitms of the insured. I don't know much about getting into an accident, all the other times that weren't my fault, the accident was taken care of expediently and proffesionally. This is just an ugly nightmare, thats going to just get worse once I try and recover my other damages.
What we all really need is a support group!

I recieved a fair property damage settlement!!!!!

After 3 weeks of stress and paperwork, Safeway Insurance finally made a VERY fair offer on my property damages. The settlement does not include my personal injury(which I plan to file with them next). I just wanted to post this and tell everyone that is having problems with the company to stay on top of it. Write letter after letter, call the corporate headquarters and complain to them. After the recent bad publicity, this company seems to want to play ball.
Make sure all of your paperwork is in order, there is no need for the comapny to have your social security number, medical files, or any other personal info. Write a demand letter with the words GOOD FAITH in it and they will jump. They have been accused of BAD FAITH, so right now they are trying to keep the Insurance Commissioner off their back.
I don't know how the personal injury claim will fare, but now that I am over one hurdle, I plan to attack the next with just as much tenacity.

I went to traffic court today and the gentleman that hit me was there. He pleaded guilty to following too closely and the judge gave me a copy of his plea. She then told me to let the courts know if Safeway Insurance pays my claim. I have faxed and mailed all my paperwork to Safeway twice. I am going to do it again, return receipt requested.
Heck, I'll charge them for the expense. I want to see what they do now that their insured has pleaded guilty. They can't dispute that. And the insured seems to be having trouble with his claim too. Well that doesn't seem too surprising.
I will post more as I get the information!!!!! Keep at these people. And start calling their corporate headquarters!!!! The more people that call and complain, the more likely they will move a little faster. I call almost every day. I will until this is settled.
