Scamfraudalert.com, Archie Richardson scrapes/ copies content from Ripoff Report, then files False DMCA notices To Google. emails show Archie admits taking Ripoff Report content but does not want Google to know Well Archie, Google knows and so does everyone else.

AUTHOR: Ed - (USA)

POSTED: Tuesday, October 16, 2012

On a regular basis Ripoff Report is the victim of websites  constantly scraping / stealing our content. In the past Ripoff Report won a lawsuit against complaintsboard.com for stealing tens of thousands of pages from Ripoff Report. It is believed that  website take Ripoff Report content so they can get high placement on search engines off the backs of Ripoff Report. There are many more website that have done the same thing and shut down.

The following is an email string showing how scamfraudalert.com is trying to hide that it copied content from Ripoff Report.

NOTE: the only thing Ripoff Report Removed from these emails is a name of a person who had nothing to do with these emails. Not sure who they were or why that name was in the email subject box.

Dear Google:

This is to notify you that the posts which were the subject of the above referenced DMCA notices and counternotifications have been removed by Scamfraudalert.com.

Following Scamfraudalert.coms submission of the counternotification, the operator admitted that he had copied the posts but refused to withdraw his counternotification.  He admitted that the only reason he sent the counternotification was because I do not want [G]oogle searches of scamfraudalert showing a DMCA Notice from Ripoffreport.com.   This is important to me.   (email below).

The operator of Scamfraudalert made the following commitment: Posts that have been copied and ED has expressed dissatisfaction, I will modify each and ever one to avoid any infringement and going forward in the future will not copied (sic)  or scraped (sic) ROR reports. (email below).

In summary, Scamfraudalert.com submitted a false counterfnotification to Google solely because they knew it looked bad on them to have scraped RipoffReport content.

Then you should not have violated the DMCA.  Ed is not going to let it go unless you agree to send corrections to Google.

Respected. All I am asking of him is to LET IT GO. I have promised that I will work with him. What more can I do or SAY. I do not want a DMCA Notice appearing in searches in reference to SFA.

Archie:

You copied reports from ROR without permission.  Then, you sent a counternotification to Google in which you misrepresented that the reports were not copied.  Ed is not asking for money damages, he is simply asking that you discontinue your infringment and correct your misrepresentations.  His position is very reasonable.

If you are not willing to contact Google and correct the false statements you made to them in your DMCA notice, we have no chance of a resolution.  I will begin preparing the copyright infringement lawsuit.

Maria:

Contacting Google is not an option. When the site gets up and running, I would like to work with ED and you to modify all posts he has identified as copyright.

Reporting on scams is of interest to the general public. As you know, scamFRAUDalert started in 2005. ED never voiced his concerns or  contacted me regarding his dissatisfaction until I initiated contact with him in 2009 regarding a different matter.

The Better Business Bureau and Ripoffreport.com are like the Associated Press. News outlet feeds off the Associated Press reports. Likewise, scams sites such as mine feeds off BBB and ROR.

Posts that have been copied and ED has expressed dissatisfaction, I will modify each and ever one to avoid any infringement and going forward in the future will not copied or scraped ROR reports.

Please let us work together and to reach an amicable resolution.

Respectfully,

Archie

Dear Ms. Speth:

Please do everything with in your powers to prevent this from going through the legal process.

I do not fully agreed with the proposal Ripoff Report/Xcentric have put forth. There is no need for this to go through the legal process. I do not want google searches of scamFRAUDALERT showing a DMCA Notice from Ripoffreport.com. This is important to me.

Please let's have a chat about this before either of us do anything that would not benefits either party in the long run. This can be totally avoided.

Your cooperation into finding a peaceful resolution would be greatly appreciated.

I will contact you when the site is back up LIVE.

Respectfully,

Archie Garga-Richardson

Archie:

In order to resolve the copyright infringement issue, Xcentric/Ripoff Report has the following proposal for you:

1.    You must either keep the scamfraudalert website off the Internet or, if it becomes live, you will remove all of the reports that were scraped from Ripoffreport.com.

2.    You must agree that you will not scrape any content from Ripoff Report in the future.

3.    For each counternotification you sent to Google, you must send another email to Google at the same address as you sent your counternotification and notify Google that your counternotification was in error.  Use the Google reference number from the subject box of the email that you received from Google.   Forward a copy of each email to me to confirm that you have done it.

If you take each of these steps, Xcentric/Ripoff Report will release you from liability for your copyright infringement.  In other words, it will agree to not file a lawsuit against you for copyright infringement.
