My mom and I decide to have a new construction property built in Mississippi to help rebuild down in the Gulf region. We also saw this as a great investment opportunity because of the GOZone tax incentives and forgivable loan. Not knowing much about the builders we naively signed a contract with Don Anothony of Royalty Homes in Mississippi. Don had a partnership with Scott Allan who is a part of AJA Holdings LLC in New Jersey. I never spoke with Don, but Scott was the one that would call me and let me know how the progress was coming along on my property until he stopped calling to report.

We were told that it would take no longer than 3 months to build our modular home. We signed the contract back in spring of 2008. As of today, (March 2009) my property is still not finished. I have moved on to a new builder and the reason is because both Scott and Don did not communicate with me or anyone else about the problems they were having. This has cost me thousands of dollars in interest payments on the construction loan as well as money to fight the liens.

They have left several clients without finished homes. Scott actually hung up on me when I called him to find out what was taking so long. They took most of my construction loan ($130K) and I'm not sure what they actually did with it. There are a few contractors that are putting liens on Scott and Don's clients because they were not paid. These two must have already spent the money.

And now Scott is preying off of other unsuspecting people in Florida trying to drum up new business. He has left a mess in Mississippi and now he thinks he's going continue with business as usual.

Please do not do business with either one of these guys. Remember Don Anthony (Royalty Homes) is in Mississippi and Scott Allan has a few businesses. AJA Holdings, LLC in New Jersey and Gulf Coast Realty in Ft. Myers, FL.

#2 REBUTTAL Individual responds

Response To Tiffany

AUTHOR: Stallan20 - (U.S.A.)

POSTED: Wednesday, March 11, 2009

This is Scott Allan. In response to Tiffany's complaint, I will acknowledge my involvement and be the fall guy for something that was beyond my control, however, it is important to know facts which I have reported to my attorney in e-mails, corporate papers, etc on this specific case...

In 2008, I acted as a referring real estate agent to Don Anthony, Inc aka Royalty Homes. My job in the past has been real estate consulting / development, slightly different from your typical realtor. My job is to put together the pieces, ie. product location, financing, selecting a builder, and property management reference. I have done this for several high ranking positions in the last few years including a well respected bank. To make things clear...I am a real estate advisor and licensed agent. I am NOT a builder, however I do work closely with several very good ones, and have been burned by some bad in the past. Most agents in construction have.

Miss Tiffany's property in Mississippi was arranged by me. Everything was going as planned. Once she closed on her construction loan, the bank issued a "start draw" to Royalty Homes. Due to the fact that I am not even on the corporate papers with Royalty Homes, how am I supposed to have access to the funds? I don't and anybody who is competent enough to do their own due diligence will see this. Construction came to standstill and I inquired to Royalty as to why. The owner of Royalty did not return a single call or e-mail sent by me for over 2 months...all of which I have record of. I also have documents showing that I was even lied to by the owner of Royalty in terms of commencement.

In December 2008, I sent an e-mail to Tiffany and mentioned that she attempt to contact Royalty directly as I was unable to do so. That was the last I attempted Royalty and the last I heard from Tiffany. Did I stop communications with Tiffany? Yes. I sent one last e-mail to Tiffany as mentioned above and had to step aside since I could be of no help tracking down Royalty who is the one who dropped the ball. Due to my job being incomplete due to Royalty, my compensation (which always comes at the end) was never paid. What I should do is file suit against Royalty for compensation. My compensation of $5,000 was not worth my efforts and expenses for paying an attorney, filings, etc to go after Royalty.

That being said, although unfair, I will take accountability for Royalty's actions. In the end, I did refer Tiffany to them. It is my job to look into construction companies prior to engaging business to see their worth. All checked out, but for some reason, they ended up screwing everyone involved.

In response to Tiffany's remark about me filing suit against her, I have to keep my options open. I am in real estate and many people know me. This report is misleading to my duties/responsibilities, and if it takes me filing slander / liable charges against those that report misconceptions, I will do so to protect my name.

Update:Scott Allan - AJA Holdings, LLC NJ, Don Anthony, Royalty Homes MS

AUTHOR: Tiffany - (U.S.A.)

POSTED: Tuesday, March 10, 2009

Since filing this report, I've been contacted by Scott Allan and although I am not removing him from the original complaint, I do feel obligated to correct some things I said. First, Gulf Coast Realty is not involved in this matter what so ever. I want to make that clear. Second, I do not know the exactly working relationship that Scott Allan had with Royalty Homes. I can tell you that Scott was the only person that I talked to in regards to the progress of the home. He had a working relationship with them, but as I said, I have no idea what that is. Scott was involved with my project (ie. working with the bank to get the construction loan, keeping me up to date on the progress of the house). Third, I have no idea who handled the construction loan money, but whoever did mismanaged it because I am still having to pay money out of pocket and some sub-contractors have not been paid. Sounds like some of my construction loan was not used on the house. Fourth, AJA Holdings is not a NJ corporation.

I've been ordered by him to remove him from this complaint, even threatened with a law suit. Ripoffreport.com does not remove complaints. I suggest that he file a rebuttal, but I do have a right to add him to this complaint because he was involved. I agree that I didn't have the contract directly with him (it was with Royalty Homes) but he was involved.
