In April of 1999, I paid this account in full, closed my account, and cut up the cards.
I have been repeatly called customer service over the past five years to get this account closed once and for all, which each time the associate from Sears states that they will enter it in the computer as closed by the consumer. However, Sears still has not ever closed my account.
In fact, I just called them again on June 03, 2004 and stated again that I want my account closed with them and was told by a Sears associate that they would take care of it. However, when I called to verify that it was closed on June 04, 2004, I found out that it was still open.
This Sears account is affecting my credit report with regards to obtaining other financial considerations. Because it appears that I could go and charge thousands of dollars on this account and then not be able to take care of other obligations.
Is there anything that can ever be done to force Sears to close my account, because I do not owe Sears any money or ever used the account since before April 1999 and have asked repeately for them to close the account?
Is it legal to force a credit account on someone when they don't want it?

I started e-mailing customer service department at Sears on a constant basis. June 6, 2004 I sent over 300. June 07, 2004 I sent over 550. June 9, 2004 I sent over 600.
The administration office at Sears finally called me on June 09, 2004 and stated that the account is finally closed and that they are updating my credit report to state that the account was closed by consumer. They are sending me a letter to support, I haven't recieved it yet.
I guess they finally decided that it was better to close my account than to get hundreds of e-mails every day.

on June 05, 2004, I sent an e-mail to Sears Customer Service to close my account immediately one more time.
I recieved an e-mail from Karen Aolucci from Credit Services on June 06, 2004 @ 7:44a.m., which stated that my account has been closed and they will send me a confirmation letter by U.S. Mail.
However, on June 06, 2004 @ 10:21a.m. I called the customer Service number 1-800-917-7700, my account was still open. Do they (Sears) really think that I am to stupid to verify that it was closed or not.

My goodness I know from where your pain lives. I tried for years to get off -- as just CO-CARDHOLDER -- not even the main card holder, of an account. YEARS! Why the hell is this company so rediculous about this???? I was worried that the account holder would not pay the bill at some point, and any negative would also be reflected on me! I WANTED OFF! IMMEDIATELY... and couldn't get it.
Even to this day, it's still not quite right. Still shows on my report as an open account, that I'm a joint cardholder... but at least they stopped reporting the monthly balance and activity a few years ago. With all the fighting I had to do to get just *that* far, I was exhausted and figured that was good enough. I'd take what I could get.
In your case, though, you need it CLOSED. You know, you might show up in person... and I don't mean to Hoffman Estates.... to your closest Sears store. They will have a Credit Department.
Were it me, virtually every business day I'd call the main number, inquire as to the account's status. With each report that it's still open, I'd make the time to visit the store. And not be very nice... AT ALL. Not over the line, just not terribly quiet and not terribly nice. And they'd see me every day until it got closed. The store's department supervisor would be very motivated to be rid of you, and could work with the corporate entity to get you out of his/her hair.
That's just me, though... I realize many people simply don't have the luxury of time to go through all that daily.
